If SCOTUS declares the energy rule to be unconstitutional and also declares that the Remain in Mexico rule cannot be rescinded in violation of the APA it will make the Dems’ heads explode. They have lost the religion case, Roe v Wade and NY gun case already. That’s 5 major cases this session that “if Garland had been confirmed” that would not have been ruled against the left.

You are correct... the fundamental issue is the 17th Amendment.
It’s past time to repeal the 17th Amendment and eliminate the Senior Executive Service.
I'd like to know what the case was that resulted in that decision because there already is The Uniformed Services Employment and Reemployment Rights Act (USERRA).
Maybe it was an employer's violation of that law that made it to the Supreme Court.
The question I have is how does an employer adhere to the law if that employee's department was eliminated while in the service.
Back in the early 80's, my unionized manufacturing plant in Detroit sold off a division that resulted in the loss of approx. 300 jobs. After that, an employee who was serving 4 years in the Army was discharged and requested to come back to work in the department that no longer existed.
I can't remember how that turned out but I think we had to place him on layoff status due to his low seniority. Meaning, the employees who lost their jobs had the right to bump into another department if they had higher seniority, which this Vet didn't have......

Why wouldn’t environmental laws be the purview of the states?
West Virginia vs. the EPA asks whether important policies that impact the lives of all Americans should be made by unelected D.C. bureaucrats or by Congress. This SCOTUS could well decide that ruling by executive agency fiat is no longer acceptable.

This was the TX state troopers firing a guy who had deployed to the sandbox and came back with damaged lungs from being around a burn pit. He should have a lot of back pay coming to him.
