It’s the prosecutor who needs to be under arrest. Tampering with evidence.

I would think it would be a serious problem in any event — but if the jury thinks the video is a crucial piece, and if the Prosecution withheld this crucial evidence from the Defense, then that seems unforgivable.

The video was withheld from the defense, in violation of the law regarding the sharing of evidence. Last night, the defense filed a motion for a mistrial based partly on the prosecutorial misconduct about the video. He hasn't made a decision on the video yet. He cannot let the jury watch this disputed video.

But this nightmare is his own making. He let the state run this trial, and now he finds out they are crooked.

Looks like he will have to rule a mistrial, hopefully with prejudice.

Lets look at the misconduct:

a) Not serving the Grosskruez search subpoena (withholding evidence)
b) Witness tampering (Grosskreuz' testimony changed 180 degrees upon cross exam)
c) Brought up Kyle's initial silence (5th Amendment)
d) Misleading evidence, withholding data regarding the modified video. Withheld information the the software manual explicitly states that enlarged photos are not for forensic use
e) Failure to provide defense with original resolution video
f) deliberate misstatements of both the facts and the law

This idiot judge never should have given the jury the weekend off. They should have been sequestered on Friday. And now he’s commenting on what’s in the newspapers?

This is a jury looking for some way to convict an innocent man. Total sham of a trial and a Judge.

Is it possible that the state prosecution really didn’t want to prosecute Kyle?

Is it possible the state, judge, jury are all terrified of the mob going crazy?

Was this all indeed a ‘show trial’ to appease the mob and it backfired?

It is now de-facto that the jury is considering video evidence. I am of the opinion that the judge has no other viable option that to declare a miss-trial.

Enough of this shilly-shallying and whining by the judge. Be a man and END IT ALREADY!!! The trial was not fair and he knows it.

We have heard that there are threats to the judge and to his grown children. Maybe he is thinking about those threats just as some of the jurors might be thinking of threats to them and their own lives too.

Breitbart is reading into the Judge’s quip. He could mean many things, including that the jury might want to review much of the video evidence. Video could require video technicians with knowledge of the video. Do you allow the prosecutor’s video people to do this? What if the jury has questions about the video? Who answers? This would be a good time to throw out the “unicorn video”, or even better, declare a mistrial based on prosecutorial misconduct.

Because it is now time to dismiss this case with prejudice and he was hoping the jury would bail him out and he would not have to do the right thing.

Every evidence ruling has good reasons for going either way and sometimes a Judge has to figure out the best way to deal with a pile of dog excrement. The Judge was given the enhanced video late in the game it is true. Laid ontop of that, there was the enhanced image. He decided on the side of giving it to the jury, without a reopening of the evidence, because the case went in on the assumption the high Def video did not exist. The defense tried their case based upon the non-existence of this evidence. They gave a right to make strategy decisions based upon the evidence. Closing arguments have already been made. The submission of evidence part of the trial is over. The nightmare is that the jury learned from the media that there is a new high resolution video. And they have asked for it. So you either keep it out, or let it in, and give the right to offer new evidence and more closing arguments, which is a total mess.

He admitted very dubious evidence that he knew was dubious.

This is not good news for Rittenhouse. If the jury is looking at this closely, it means they are taking the prosecutions bogus provocation argument seriously.

They should have laughed it out of court when they saw a video that has been doctored that you cannot make sense of even then.

The judge knows that his family,and the families of the jurors,will be in danger if the jury doesn’t vote “correctly”. And there’s no way that the jurors don’t know that as well. That’s why Rittenhouse will be convicted of *something*...it’s just a question of what.
