The National Labor Review Board had released email exchanges between Google senior executive Urs Hölzle and former engineer Kevin Cernekee The correspondences show how Hölzle attempted to silence the employee from sharing his political beliefs and said his behaviors were 'entirely inappropriate'

Cernekee reported the comments to the NLRB and filed a complaint arguing that the company was bashing white males

NLRB regulators ruled that Google was 'justified' in firing Cernekee for alleged improper use of company equipment

They also determined that Hölzle violated labor laws and infringed on Cernekee's first amendment rights

This might be the second Daily Mail article today that just gets something significantly wrong about the U.S..

The First Amendment generally does not apply to actions taken by private employers. Some state laws might make provide protection for such speech, but this is the NLRB so it is federal. So I don't think this actually involves the First Amendment at all.

I think this actually involves a violation of Section 8(a)(1) of the National Labor Relations Act, which bars employees from being disciplined for taking collective action with respect to their terms and conditions of employment. And complaining oato management on behalf of all employees about an unfair workrule qualifies as "protected activity."

But the First Amendment shouldn't have anything to do with it.

Most DM articles get something significantly wrong about almost anything. "Sloppy" is their business model. Starting with "National Labor Review Board."

Haha! I didn't even catch the "review" board thing. The whole First Amendment claim had me intrigued as soon as I saw it, so I was pretty much reading just to figure out what was actually going on. Didn't actually see Section 8(a)(1) mentioned anywhere, but I did see something talking about it violated his right to "collective action", so that was the tipoff.

I like having conservative media as much as the next conservative. I just wish they'd get their facts right.
