Texas Supreme Court orders 08.15.21 (stay orders granted in mask-mandate cases)
Texas Supreme Court (email advisory) | 8/15/2021 | Osler McCarthy

Posted on 08/15/2021 3:15:46 PM PDT by The Pack Knight

AUGUST 15 ORDERS

The Texas Supreme Court on Sunday granted stay orders against temporary retraining orders by courts of appeals in San Antonio and Dallas that allowed mask mandates despite the governor’s executive order prohibiting them.

The courts granted the orders against Gov. Greg Abbott to bar enforcement of the executive order. A hearing on a temporary injunction in the Bexar County case, scheduled Monday, is not affected, nor is a hearing on a temporary injunction in the Dallas County case set August 24. Briefs in 21-0686 (Dallas County) Briefs in 21-0687 (Bexar County)

Just received by email from Osler McCarthy, staff attorney from the Texas Supreme Court. Basically, they just issued a stay stopping The Dallas and Bexar County mask mandates.

Link to the orders here: https://www.txcourts.gov/supreme/orders-opinions/2021/august/august-15-2021.aspx

So its an injunction on the cities restraining order regarding the executive order restraining mask mandates?

Court reporters need to be beaten with rubber hoses until they can report what actually happened, instead of the reader needing a Harvard Law Degree to dimly guess at what they’re trying to tell us.

Not exactly. Several state district courts issued temporary restraining orders preventing the governor from enforcing his executive order prohibiting local mask mandates. The Texas Supreme Court just issued an order staying those TROs, and thus allowing the governor to enforce his order.

Normally I agree, but this email is specifically meant to be read by lawyers.

Yes. There is no mask mandate in the various locales of Texas.

In plain English.

Local Democrats in Dallas and San Antonio defied the order not to institute mask mandates. Governor Abbott went to Court and two lower appeals courts ruled against the Governor.

It was appealed to the Texas Supreme Court, and the Texas Supreme Court just smacked down the lower courts and issued a stay.

Thus, the mask mandates are off.

Ping!

Our area districts were ignoring these absurd mask mandates, anyhow.

So, this just gives their decision(s) more credence.

well that’s what I thought it was saying, but it is worded so poorly that I could not be sure. Why not say what you just said. Idiots.

By the way, the 4th and 5th Courts of Appeal are stacked with Democrats.

The media slime are all starting their gnashing of their teeth decrying that the Texas Supreme Court is “all republican” while ignoring that the 4th and 5th Courts of Appeal are all Democrat.

And read the whole thread. The article it came from is so convoluted, it takes, as one poster said, a law degree to decipher it. LOL!

Walked out of two places in Dallas County today, including about 30 mins ago. I should go back and say, “Boom! Suck it, b**ches.” But, they could still say, “Private business, so….”

Lest we forget, there are always appeals to higher courts.

Will these plaintiffs now appeal to the Supreme Court?

Thanks. This is just from the Osler McCarthy email subscription, which isn’t really intended for lay public consumption, but I wanted to get the news out for anyone who has been following.

One thing I would add is that this is all temporary and only the beginning. The underlying orders stayed by this order are TROs, which will expire tomorrow and 8/24, when the temporary injunction hearings are currently set in the respective trial courts. I expect each district judge (both Dems) to grant a TI against the governor, but the governor will appeal. That will result in automatic suspension of the TI. The courts of appeals may (and probably will, because they are both majority Dem) grant the counties temporary relief reinstating the TIs under Rule 29.3 of the Texas Rules of Appellate Procedure. The governor will petition the Texas Supreme Court for mandamus from those orders, which the Supreme Court will probably grant.
