Ashli Babbitt's family say they will sue Capitol police for $10million claiming the cop who shot her 'ambushed' her and gave no verbal command before pulling the trigger
Her family's attorney says they plan to file a wrongful death lawsuit They say video shows the cop who shot her gave no warning beforehand
His attorney insists that he did but that it's not audible because he was wearing a mask and videos are filmed from too far away
'He was screaming, 'Stay back! Stay back! Don’t come in here!' the officer's lawyer, Mark Schamel, told Real Clear Politics.
He added that he was within his rights to shoot.
'He was acting within his training. Lethal force is appropriate if the situation puts you or others in fear of imminent bodily harm.
'There should be a training video on how he handled that situation. What he did was unbelievable heroism,' he said.

I say bless them as they go forward. The case is a certain loser, and they will be taking a very uncomfortable emotional roller-coaster. Courts are bad places. The only winners are the judges and lawyers. Even if you win, you lose.
The law is stacked in favor of the state, always. Law is the state’s tool. It takes its orders and contours from the state. The courts and the state resent the part where the public gets to interface, jury, This case will never get to the jury stage.
They should make a new law that before you shoot and kill someone in a crowd, you’re allowed to remove your mask to issue a warning, FFS. So in essence, he’s saying if not for this silly paranoid behavior over Covid, Ashli would still be alive.

Make the cop who shot her pay; take everything he owns and will own then let the gov’t make up the difference which means who pays?.... us.
Babbitt shouldn’t have been shot to begin with and a wrongful death suit against the Capitol Police is entirely appropriate. But I’m not aware of anything that says an officer is legally obligated to give a warning before shooting. It makes sense to but it isn;t a legal requirement.
