Arrest Warrant Issued for Texas Democrat Who Fled to D.C.

The Texas Speaker of the House of Representatives issued a warrant for the arrest of a Democrat member who fled to Washington, D.C. to avoid a special session. The San Antonio-area Democrat traveled to the nation’s capital with fellow legislators to break quorum and prevent the House from voting on legislation involving election reforms.

Speaker of the House Dade Phelan (R-Beaumont) signed a civil arrest warrant on Monday for State Representative Philip Cortez (D-San Antonio) for his failure to return to the House of Representatives, the Texas Tribune reported. Cortez abandoned his fellow Democrats late last week when he unexpectedly returned to Texas. Cortez claimed he returned to Austin to attempt to engage in a “good faith dialogue” on the matter of House Bill 3, the election law reform bill

Good post from Political Junkie Too about this yesterday.

Providing benefits to a legislator to keep them from voting is considered to be bribery under Texas law.

Hopefully, this newly found backbone will not melt in the 100-F heat.

Put Cortez in one of those covid testing tents out in front of the state capitol. Be sure to unplug the portable air conditioning units while Cortez is “cabined” in the tent.

I Just caught it on the radio that Gov. Abbott will call another special session starting just as the current one expires.

Looks like we will see how long the others want to hold out.

And I expect there will be more arrests when they come straggling back in.

If they wanted to have a “good faith dialog” there was a place to do that but they ran away from it.

Civil cases usually involve private disputes between persons or organizations. While criminal law and civil law are different, there is some crossover.

Both the plaintiff and the defendant are also referred to as "parties" or "litigants." The plaintiff may ask the court to tell the defendant to fulfill the duty, or make compensation for the harm done, or both. Legal duties include respecting rights established under the Constitution or under federal or state law. Civil suits are brought in both state and federal courts. An example of a civil case in a state court would be if a citizen (including a corporation) sued another citizen for not living up to a contract.

So it seems to fit.

Great news!

Is there a point that they can be “fired” or removed from their jobs as representatives for failing to do their duty? Would that require a recall vote by the public? Or throwing them out at the next election?

When they walked out, Abbott vowed to defund the legislative branch for “abandon[ing] their responsibilities.” He then carried out the threat Friday June 18. He vetoed Article 10 of the state budget, which was sent to his desk the same day. That article funds the state government on all staffing levels, including the salaries of the individuals sitting in the state legislative body.

Texas Democrats then petitioned the state Supreme Court to reverse Gov. Greg Abbott’s choice to defund the legislature. The suit declares that Abbott’s line-item vetoes were unconstitutional and for that reason must not have any result.

The bastard dems are using their campaign funds and contributions for living expenses. All the lowly staffers are getting screwed big time.

they need to change the “per diem” rule so that they only get paid if they are in Austin doing their job!
