Arizona law generally makes it very easy to vote. Voters may cast their ballots on election day in person at a traditional precinct or a “voting center” in their county of residence. Ariz. Rev. Stat. §16–411(B)(4). Arizonans also may cast an “early ballot” by mail up to 27 days before an election, §§16–541, 16–542(C), and they also may vote in person at an early voting location in each county, §§16–542(A), (E). These cases involve challenges under §2 of the Voting Rights Act of 1965 (VRA) to aspects of the State’s regulations governing precinct-based electionday voting and early mail-in voting. First, Arizonans who vote in person on election day in a county that uses the precinct system must vote in the precinct to which they are assigned based on their address. See §16–122; see also §16–135. If a voter votes in the wrong precinct, the vote is not counted. Second, for Arizonans who vote early by mail, Arizona House Bill 2023 (HB 2023) makes it a crime for any person other than a postal worker, an elections official, or a voter’s caregiver, family member, or household member to knowingly collect an early ballot— either before or after it has been completed. §§16–1005(H)–(I). I read the entire 85 pages and this is what I thought is the most important paragraph.

How many times have you heard from a leftist that there is no reason to change election laws because no or minor election fraud has occurred?

The Court of Appeals thought that the State’s justifications for HB 2023 were tenuous in large part because there was no evidence that fraud in connection with early ballots had occurred in Arizona. See id., at 1045–1046. But pre[1]vention of fraud is not the only legitimate interest served by restrictions on ballot collection. As the Carter-Baker Commission recognized, third-party ballot collection can lead to pressure and intimidation.

And it should go without saying that a State may take action to prevent election fraud without waiting for it to occur and be detected within its own borders.

Section 2’s command that the political pro[1]cesses remain equally open surely does not demand that “a State’s political system sustain some level of damage before the legislature [can] take corrective action.” Munro v. So[1]cialist Workers Party, 479 U. S. 189, 195 (1986).

Fraud is a real risk that accompanies mail-in voting even if Arizona had the good fortune to avoid it.

He made some pretty snide comments about the dissenting justice’s “arguments”. Definitely a slap-down opinion. Read through it yesterday. It was well done.

Well...never. Utopians that the leftists are; the ideal of counting every vote is infinitely more important than the miniscule, infinitesimal instances of fraud AND WE KNOW THAT IS THE CASE AND WE KNOW that Repubs are every bit as likely to commit fraud as Dems.

Do we see how the rhetoric is elevated to near-fact?

I like the hierarchy, if you will, that he laid out as the difficulties of voting.

You show up at the wrong precinct and your vote may not count. Let’s see, you have an appointment with your doctor and instead you show up at your dentist. WELL YOU MAY NOT GET TO SEE EITHER ONE.

...whether whimsical or considered. Whether citizen or not. Even to those who openly state their interest is to destroy the system.
