Fort Hood sergeant indicted for murder in 2020 death of Austin protester

AUSTIN, Texas (KWTX) - First Cavalry Division Sgt. Daniel Perry, who shot and killed a protester at a Black Lives Matter protest in June 2020, in Austin, was released after a posting a $300,000 bond following his indictment Thursday in Travis County for murder and aggravated assault with a deadly weapon.

“Sgt. Perry will vigorously fight all of these charges,” Perry’s attorney, Clint Broden of Dallas, said after the indictment was handed up Thursday.

Garrett Foster, 28, was shot to death shortly before 10 p.m. July 25, 2020, at the corner of Congress Avenue and 4th Street in Austin after Perry, who was working as an Uber driver to earn extra money, turned from 4th Street onto Congress and encountered the protesters.

“When Sgt. Perry turned on the Congress Avenue, several people started beating on his vehicle. An individual carrying an assault rifle, now known to be Garrett Foster, quickly approached the car and then motioned with the assault rifle for Mr. Perry to lower his window,” Broden said at the time of the incident.

Perry drew a handgun he was carrying for personal protection and fired, killing Foster.

Infuriating. WTH are Abbott and the TX AG?

Throngs of rioters can stop your car in the middle of the road, threaten your life with a rifle and if you defend yourself, you get charged with murder....in Texas.

I'm afraid even if he's pardoned by Abbott, Biden's DoD will still do him at court-martial or in federal court on civil rights charges.

Texas may be one of the few states where the Executive enjoys very limited pardon power, if any at all. This guy could be screwed.

He committed the heinous crime of self defense. Killing in self defense is a much more serious crime than premeditated murder. Premeditated murder is a sign of mental dysfunction and therefore cannot be a crime. Self defense is a rational act and thus the conscious aware killing of a person and therefore is a serious crime. I have actually heard this from hi IQ people more than once. IQ does not indicate rationality.

It’s Austin, one of the biggest Marxist strongholds in Texas. Get rid of the Un. of Texas and you might get a handle on the reds. Otherwise, it’s a real “red city”.

Not the whole county, but Austin. Once you leave the Austin metropolitan area, it's like a whole different country.

His defense will be a suit brought against the local DA for wrongful prosecution. Texas has a castle law. If I'm not mistaken, he was defending his life from his car.

Testimony from the investigating officer should be revealing.

The observation about the Castle Law is appropriate.

This case should get removed from the court calendar before it ever gets to trial.
