Important excerpt from the Kevin Clinesmith Criminal Information:
On 8/17/16, the CIA informed the Crossfire Hurricane team that Carter Page had been a CIA source.
They hid this fact from the FISA Court.
I bet the DOJ will invalidate the first 2 FISAs.
“I bet the DOJ will invalidate the first 2 FISAs.”
By 2029.
The deeper question is did Durham get this perp to talk, talk about anyone above him?
The deeper question is did Durham get this perp to talk, talk about anyone above him?
sounds like it...Lawyer says he also gave a copy of the unchanged e-mail to his bosses
Bet on it.
I don’t want people to be fired, I want them to face criminal prosecution, for charges up to and including treason against the United States of America. And punished to the fullest extent of the law if convicted.
Maybe. But if he spilled the beans, why is he being indicted? Why didn’t he trade info for immunity?
You don’t have much leverage in a plea negotiation by offering information about people below you.
Yes. But we are not hearing of a plea deal at this point are we, so it would seem Durham has not yet gotten him to implicate anyone above him. If he had, we might be hearing of a plea deal today instead of a mere filing of charges.
In the fed system you can apply for up to a 50% downward departure of your sentence for significant cooperation that assist the government. That is it and that is the way it is supposed to be.
Clinesmith is no Clinton and Durham is showing he is not a patsy.
I bet the DOJ will invalidate the first 2 FISAs.
They have to invalidate them. Even better, ask the FISA court to review the information and have THEM invalidate them.
As Barr said, this is not Earth shattering. The Earth Shattering will be coming a bit later.
Mostly working at CNN/MSNBC or a law firm and may have written a book. Crime pays for dems
Something else to consider in light of today’s announcement and Barr’s rather cryptic statement last night on Hannity....
Barr (paraphrased) described this as a “minor development” in the case. Most prosecutors would sell this as a major announcement. Remember the farcical indictment press conference for the Russian troll farms? After all, this was a senior FBI attorney in the middle of the investigative team.
“Minor development”
Hmmmmm?
Um, he's pleading guilty to a felony. This would appear to mean that they've gotten what they want out of him and they're allowing him to plead to a single charge in return for his cooperation. I suspect they will delay sentencing until he actually testifies, if needed, in any upcoming trials of those above him.
“But if he spilled the beans, why is he being indicted? Why didnt he trade info for immunity?”

Is it possible, Durham offered him the option to plead guilty to this lesser charge (falsifying documents) and NOT be indicted on more significant charges of conspiracy/sedition/treason in exchange for his cooperation in the probe...
...like ratting out his superiors...???
If he plead guilty to an Information, he made a deal. Trust me, I know. I negotiated MANY an Information with the USAO.
The Feds RARELY give anyone immunity. Usually the best deal you will get is pleading guilty to an Information.
