I’ve always despised John McCain but thought he’d win against Obama (up until the banking crisis and his idiotic “you don’t need to fear Obama” comment).
I’m sure I will be wrong again :-) ... though not as often! :-)

Despite their political leanings, I believe this court will attempt to avoid making a decision which would set a bad precedent for the DC Circuit. I expect a decision holding that since Sullivan has become a party to the case, he must recuse and a new judge be assigned. The mandamus order to Sullivan will not be binding on the new judge who will be instructed to dispose of the DOJ request to dismiss in line with existing Circuit president.
He obviously, really does, "know where the (Democrat party) bodies are buried".
What else explains the bizarre way his case has played out?

Correction: Circuit president should be Circuit Precedent
That is what I was thinking too after the order granting the en banc hearing. We will just have to wait and see, although I find these legal battles intriguing.
You cannot be both the judge and the appellent in a case. The En Banc justice who writes the decision will have to reconcile that conflict. You have to be a party to a case in order to appeal and if the court has decided decided that Sullivan has standing to appeal then he cannot then be the judge in the case. That conundrum is what is what faces the liberals on the court if they grant Sullivan what he wants and appellate courts don’t like to be overturned.
The appeals court should not have taken the appeal in the first place and the liberals on that bench are looking for a way out and very possibly a way to drag this case out even further.
just a delaying tactic. Giving this the slow roll. They already know how they will decide.
