Miers was initially nominated to replace the retiring O’Connor. When the Miers nomination blew up in W’s face he nominated Roberts.
Before the Roberts confirmation process started Chief Justice Rehnquist died. Bush switched Roberts to fill the open CJ seat.
He later nominated Alito to fill the O’Connor seat.
I would much rather have had an Associate Justice Miers and a Chief Justice Alito.
If only Rehnquist could have held on.
