A recess appointment is only good until the end of the term. So a few days at most if done after November elections. Plus it takes both House and Senate in recess to start the recess appointment clock.

There are no more Circuit court of appeals vacancies.

Rat vacancies dried up late last year as they are hanging on and hoping for Trump’s defeat. When he wins there will be a bunch of new vacancies as the holdouts give up.
