The linked article is not the complete ruling, but it implies that this is not a final ruling, just that the govt needs to come back with more argument than what it initially presented.
Just guessing here, I think the government came in and simply said it was an exec order, not law, therefore now expired. That SHOULD have been enough. Apparently Roberts is saying he wants more than that for argument. Now his motivations are questionable, but from the article, it seems like there is a round 2 coming.

After Citizens United, Roberts was cowed by the negative reaction the Court received from Liberals. That reaction traumatized him and he is now afraid to make another such decision. This cowardess explains his penaltax reasoning in NFIB v. Sibelius (the Obamacare decision).
Roberts is a Conservative Justice, EXPECT when he fears a strong negative reaction from The Left. Don't expect him to vote to overrule Roe v. Wade.

Procedural is nonsense. Executive determines procedures in administering laws on Scotus. All power resides within the President. What needs to happen is the entire bureaucracy needs to be torn asunder. President should not be told by anyone who to run hos government.
