Toward the end of the article, it says that rubber bullets and tear gas can be used if ordered by a captain (or above) if a warning to disperse has been given and ignored. There are a number of other conditions that must be met (violence, order must be heard and/or repeated as necessary, etc.). So, it is not an absolute prohibition.
But the judge’s language in the ruling now seems to incorporate property damage (graffiti and window smashing) as elements of constitutional peaceful assembly and petition.
Since this is Denver, the ruling won’t be appealed.
Fortunately, he's old. If we're lucky, he'll get Covid this winter and kick off, or we'll only have to put up with his Lefty cray-cray for another ten years or so.
