Open and shut 3rd degree murder in Minnesota.

The Statement of Probable Cause for arresting the policeman, charges him with 3rd degree murder and manslaughter.

In Minnesota, intent is not an element in 3rd degree murder, but Depraved Indifference is.

There is a 9-minute long, continuous, uncut, unedited, not-monkeyed-with video of the guy on the ground in cuffs.

The policeman doesn’t take his knee off the neck the whole time.

There are 3 or 4 bystanders maybe 6 feet away, two are videoing on their phones.

The guy says he can’t breathe.
He keeps the knee on the neck.

The guy passes out.
He keeps the knee on the neck.

The guy’s bowels/or bladder release—there’s a stream coming under the car.
He keeps the knee on the neck.

One of the bystanders identifies herself as a first responder and begs the cop to get off and check for a pulse.
He keeps the knee on the neck.

One of the other policemen who had been holding him down, checks for a pulse, and tells him, hey, the guy doesn’t have a pulse.

He doesn’t check for a pulse himself.
He doesn’t start CPR.
He keeps the knee on the neck for over two minutes (as recorded live on video while it happened from six feet away)
AFTER his fellow policeman says there’s no pulse.

At one point, Mr. Kneecap pulls out a can of mace to brandish at a bystander who tries to get closer to help the guy. He gets an angry look on his face. It’s the only time on the who video he shows anything but a look of smug stupidity.

There is no way in hell he escapes conviction on Murder 3.
Once the police have arrested you and put you in cuffs, they become responsible for your safety.
Once a guy passes out, a knee on the neck is excessive force. (Mr, Kneecap had 10 prior excessive force charges against him. The county attorney for at least part of that time, is now the Dem Senator from Minnesota, Amy Klobuchar, who was hoping to be VP on the Joe Biden ticket.)

Once a guy you have in cuffs has no pulse, kneeling on his neck is WAY excessive force. Zombie movies are fiction, guys without a pulse don’t suddenly become the undead and grab for your gun.

And for a 19-year veteran, to keep his knee on the neck of a guy with no pulse, for two minutes, on camera, in front of witnesses, after one of his fellow cops said there was no pulse?

Yeah, that’s kinda open-and-shut on murder 3, no matter how the guy’s heart stopped.

The Constitution is supposed to protect us against this kind of crap.

I agree with what you said - cops should have known better.

I remember seeing a cop on night at the scene of an accident - he was hyped up, sort of stomping around like a wild animal, and he arrested someone who hadn’t done a dang thing wrong - threw him in the back of his car and took off.
When it came time for court this cop “had a flat tire” so didn’t show up and the whole thing was dismissed. The cop had pulled stunts like this before apparently.
I think for some cops the constant turmoil and danger of the job is more than they can handle.

The George Floyd cop should have had a different job after 18 complaints.

That’s what’s making people so angry. We have boatloads of panels, commissions, a whole Civil Rights Division at the DOJ specially tasked to deal with these problems and yet it keeps occurring.

They did. The paramedics made a statement a few days ago, you know. They said they were called to respond to a man with a mouth injury.
The oriental policemen facing the phone video takers, has six prior excessive force charges against him, including one settled out of court for $25k, for hitting/kicking a handcuffed teenager in the mouth and knocking out teeth.
So the paramedics said they were surprised once they arrived to find the guy unresponsive and without a pulse.

Mr. Kneecap is on video when one of the other cops who had been helping to hold the guy down, checks for a pulse, and tells him the guy doesn’t have a pulse.

Mr. Kneecap doesn’t check for a pulse himself, and doesn’t start CPR (he’s a first responder and a 19-year veteran).
He keeps his knee on the neck OF A LYING DOWN HANDCUFFED MAN WITHOUT A PULSE ACCORDING TO HIS OWN FELLOW OFFICER.
For two minutes more or so.

In front of witnesses (including one who identifies herself as a first responder) and while on video, in broad daylight, on a public street.

That fulfills the conditions for 3rd degree murder in Minnesota: Depraved Indifference.
Because Intent is not an element.

You cannot know that. Period. I can just as credibly say he would have died in the squad car from Gent toxicity before arrive at the police station. There is zero way to prove either assertion. So why do you make such loaded assertions?

The knee on the neck killed a man who was in awful shape. From now on the police should get a full medical report before they deal with the scum on our streets. (/sarcasm)

Ironic that his fellow scum are now honoring his blessed memory by looting, rioting, burning.

I never defended Floyd.
The issue is the civil rights — not of a black man, but of any citizen whatsoever.
Once you are in police custody they have an affirmative duty to take care of you.
So if you call 911 cause someone’s breaking down your door, and the cops decide to stop at Dunkin Donuts first, you or your next of kin cannot sue them.
But once you are in custody, they are responsible.

And Mr. Kneecap is on (unedited, live, from six feet away) film,
keeping his knee on the neck of a handcuffed guy
when he says he can’t breathe
when he passes out
when his fellow cop says, hey, he doesn’t have a pulse

The term in Minnesota Law which fulfills 3rd degree murder is not intent, but Depraved Indifference.

For a trained, 19-year-veteran first responder to not do CPR on a man in cuffs, when his own parter just told him the guy has no pulse, fits that to a T.
No matter what caused his heart to stop.
