OK - but don't tilt the boat 180 degrees in the other direction because of a statement that says the recorded videos/audio may not be the end-all.

There's no excusing kneeling on the neck of a person who has been subdued, is under control and is saying he can't breathe...did you see the stories where Amy refused to prosecute him and other officers with a history of abuse of power complaints?

You might wonder if that "other evidence " could be some CYA stuff to reduce liability for higher up folks.

How about we wait and see what shakes out.

Actually, any lawyer with an IQ above 25 would first check the murder laws in Minnesota to see what the requirements are for Murder 1, Murder 2, Murder 3 and Manslaughter.

Hello! The town is being burned to the ground, politicians were just trying to get out ahead of the issue. What do constitutional rights and laws matter to politicians at a time like this? After Covid-19 politicians believe they can do anything and deal with the fallout later. Personally I am surprised that the police offices were not charged with failure to follow social distancing suggestions. That would have been easy for the politicians. 1. Get rid of the four police officers and 2 show they mean to enforce their “rules”.

It is highly unlikely that the officers INTENDED to kill Floyd in the act of subduing him. Intent plays crucially into any criminal charge.

In Minnesota third degree murder does not require intent. Only "perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life..." It's not hard making that case in this incident.

Hmmm. We shall see. You do understand that the act of putting a knee on the back of the neck is trained technique in the Minneapolis police department right? So him doing that was part of his training. you may disagree on why he did it or that he needed to do it for how long he kept it going, but the act itself is a legit police technique in MN.

If you’re saying that the man’s death was caused by inability to breathe due to a compressed airway, you may or may not be correct.

His death could also have been caused by a cardiac arrhythmia. Some people have hypersensitivity of their carotid sinus pressure receptors and can develop passing out spells or malignant heart rhythms with stimulation of their carotid sinuses. Kneeling on the neck could have contributed to that. Or he may have had a heart attack or any number of other possibilities that can result in sudden death.

I suspect this autopsy is pointing in the direction of one of these other causes of death ... that is, some preexisting condition that contributed to his demise.

Say for a moment all that is true. Absent the kneeling on the neck he would still be alive. It was the kneeling that killed him by triggering a pre-existing condition. So the officer should be held liable for third degree murder at least.

If I fire a shot at you and miss but you fall off the roof and die trying to get away then it isn't the shot that killed you but I'm going to face some sort of murder charge because of it.

Killing suspects in custody is not, so far as I know, is a technique the police department endorses. If you misuse an approved technique and the suspect dies because of it then the fact that the technique was approved should be irrelevant. The officer misused the technique and killed a man while misusing it so he should face charges.

They’re basically a Fort Apache on wheels, watching for people to take a potshot. The knee on the neck is right out of the MPD manual. In hairy areas, the idea is to keep the hands free to return fire from the man’s friends or ward off attacks from random ferals angry that a black criminal is being hassled.
