Lawsuit in Missouri Against Academy Sports for Selling Ammunition

On 1 May, 2020, Attorney Craig Heidemann filed a lawsuit against Academy Sports, contending they contributed to the unlawful death of Aaron “Josh” Hampton, who was one of the roommates of Luis Perez. Perez is an illegal immigrant accused of murdering three people including Hampton, another “roommate” and a woman, Sabrina Starr.

Starr is said to have supplied Perez with the gun, while another woman, Nyadia Burden, is accused of purchasing the ammunition for Perez. From AP via kmbc.com:

The lawsuit alleges a worker at Academy Sports in Springfield should have realized the woman who bought the bullets, Nyadia Burden, intended to give them to Luiz Perez. The 24-year-old Perez couldn't buy ammunition because he was in the country illegally, had no driver's license and was facing felony charges, according to police. The lawsuit also names Burden.

Perez is facing the death penalty in the Oct. 31, 2018, deaths of his ex-roommates, 38-year-old Steven Marler and 23-year-old Aaron “Josh” Hampton, and the wounding of two others. Prosecutors allege he fatally shot Sabrina Starr, 21, the next day. She had provided him with the gun he used, police said.

Perez is reported as having been kicked out by the other roommates. Revenge may have been a motive.

Perez should have been deported in 2018 but was released by New Jersey's sanctuary city rules:

“Perez should have faced deportation proceedings after a previous arrest in Middlesex County, New Jersey, but he was released because the Immigration and Customs Enforcement request didn't meet the county's required criteria.”

It is reported there were multiple warrants for Perez arrest:

The lawsuit depends on convincing a jury the clerk at Academy Sports should reasonably have been able to read the minds of the people purchasing the ammunition, and refused to sell the ammo to them.

Instead of Academy, they should be going after the SOBs in NJ that let the POS go free to start with. THEY are the ones with blood on their hands.

Well, this is in my hometown of Springfield. I doubt a Springfield jury will side against Academy (where I buy much of my ammo), but anything is possible. Still, Springfield is a very conservative and pro 2A city.

From what little I read Acadamy is the LEAST culpable of any party involved. The perp wasn’t even legally in the country, somebody else purchased the ammo for him and Acadamy is responsible?? This is madness. Acadamy needs to fight this tooth and nail and not cave. Then counter sue this hack lawyer if possible.

I am confused:

Ammo was bought in MISSOURI & killings took place in New Jersey....

New Jersey is where illegal had been released under ‘Sanctuary’ thinking.....

I don’t know how a salesperson in Missouri can be so clairvoyant.

How about suing New Jersey for releasing him? The problem is that everybody treated the illegal alien criminal as a special class of person, not applying the law to them, not jailing them, not deporting them. The end result was people dying.

This is another “old woman goes to McDonald’s drive-thru, buys a cup of steaming hot coffee, puts the cup in her lap and then gets scalded by the hot coffee.” She was a victim of her own stupidity, but she won a sizeable judgement against McDonald’s. Yep, anything is possible if everyone on the jury thinks that injury trials are supposed to be like the lottery—big wins.

This is a harassment suit designed to cost the defendant money. It should be dismissed as such and the plaintiff attorneys sanctioned

Well the lawyer represents the parents and according to his article that are claiming the bullets legally should not have been sold the buyers .

“Hampton’s family’s attorney Craig Heidemann said the family respects people’s right to bear arms but wants to encourage firearm dealers to obey the regulations in place to keep guns and ammo out of the wrong hands.”
“Just before 7 p.m. on Oct. 31, 2018, Perez, Burden and Aaron Anderson went to the Walmart on South Campbell Avenue in Springfield to buy the bullets, but the sales associate at the gun counter noticed something was off and refused to sell them bullets, according to a lawsuit filed earlier this month in Greene County.” “So, the lawsuit says, the trio proceeded down Campbell Avenue to Academy Sports and Outdoors, where Burden was able to purchase a box of 9mm ammo.”
