Wisconsin Supreme Court strikes down Tony Evers' stay-at-home order that closed businesses, schools to limit spread of coronavirus

MADISON - The Wisconsin Supreme Court has struck down Gov. Tony Evers' order shutting down daily life to limit the spread of coronavirus — marking the first time a statewide order of its kind has been knocked down by a court of last resort.

The state's highest court, which is controlled by conservatives, sided with Republican lawmakers Wednesday in a decision that curbed the Evers administration's power to act unilaterally during public health emergencies.

I've been scanning the decision. It seems to focus on the fact that the health secretary made an order that had a penalty (jail and a fine), and therefore it was a "rule" that should have come from the legislature and not the executive branch.

Going to be an interesting time as this all gets sorted out.

Interesting. I’d be willing to bet that one of these closures will eventually reach SCOTUS...and given the gravity of this stuff I’d wager that they’ll accept the case.

That leaves 10 states completly locked down, all blue states except for MI. And here in PA, rebellion is brewing,50 percent of the state counties are open.

Instead they will threaten to pull business licenses, which is what Tom Wolf is doing in PA.

Whitmer already lost one case in court today over the 77 year old barber. .
The state legislature is currently suing Whitmer over her illegal, unconstitutional diktats. She is going to get clobbered in court too.

Yes,on Thursday another protest at the Capitol in Lansing, MI. I wish I could be there. THE REPUBLICANS IN MICHIGAN ARE SUING THE WITCHMER IN THE COURT.
