Washington (CNN)A federal appeals court on Friday dismissed a lawsuit by congressional Democrats alleging President Donald Trump violated the emoluments clause of the Constitution by refusing to allow lawmakers to review and approve his financial interests.
The ruling is a major triumph for the President, who's intensely sought to keep his business affairs in private, just days after the Republican-held Senate voted to acquit him on impeachment charges for abuse of power and obstruction of Congress. The case's dismissal effectively kneecaps one of several attempts Democrats have made to dig up more information about Trump's business holdings.
Before Friday's ruling the lawsuit was paused just as Democrats began subpoenaing the Trump Organization.
This emoluments case was one of three ongoing constitutional challenges to Trump and his business, alleging that the President is violating the anti-corruption emoluments clause. Two other emoluments cases attack Trump for his alleged competitive advantage at the Trump-branded real estate empire. Those cases are still moving through the court system.
The three-judge panel -- Judges Karen Henderson, David Tatel and Thomas Griffith -- was in unanimous agreement, saying the Democratic lawmakers lack the standing to challenge the President, the US Court of Appeals for the District of Columbia Circuit ruled.
The Democrats' "claim is based entirely on the loss of political power," the appellate panel wrote in the opinion. "Our conclusion is straightforward because the Members -- 29 Senators and 186 Members of the House of Representatives -- do not constitute a majority of either body and are, therefore, powerless to approve or deny the President's acceptance of foreign emoluments."

These lawsuits waste time and the peoples money......just like the investigations against Trump. Then the Dems have the audacity to complain about the very debt they're creating!

Next step for Dems is to ask for en banc review of the decision. They won’t give up with just a panel decision. If that fails, they’ll try SCOTUS.
Now every Republican can easily shoot down this absurd Democrat talking point. This was a big win.
The left is well on its way to become a vexatious litigant within the courts and public opinion....
“Vexatious litigation” (as defined) is legal action which is brought, regardless of its merits, solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action.
This is lawfare.
The politics of this are interesting..... the democrats and the media have cried wolf so many times over Trump that people are turning them off. However, pay attention to the independents and what they say about this. They are getting mad as they do not see the democrat party doing anything other than obstructing and litigating.
Trump needs to make this a primary theme headed into the election and target the house races. The President’s policies have been effective and are helping the American people. The democrats oppose these policies and all they will do if left in control of the house is continue to be a vexatious litigant.
