Attorneys argue Trump has right to collect citizenship info

Attorneys for the Trump administration say the president has the right to order the U.S. Census Bureau to collect administrative records on citizenship.

The U.S. Department of Commerce asked a federal court in Maryland on Wednesday to dismiss a lawsuit challenging Trump’s order.

T he motion filed by administration attorneys was the latest development among several lawsuits around the nation, deriving from the administration’s failed attempt to put a citizenship question on the 2020 Census questionnaire. After the U.S. Supreme Court blocked the question from being added last summer, Trump issued the order requiring the U.S. Census Bureau to obtain citizenship information from administrative records instead.

Civil rights groups challenged Trump’s order, worried that citizenship information will be used by states and local governments to redraw legislative boundaries using only U.S. citizens instead of the entire population. They argued doing so would be advantageous to Republicans and non-Hispanic whites.

I can just see the Democrat exploding heads, if non-citizen information causes huge redistricting changes in blue states.

California, Texas, New Mexico have enclaves of red districts that have heavy illegal immigrant populations. To see those areas loose House seats would be fitting justice.

Go Trump, drain the swamp.

This is the most important battle fought in this country since the Civil War. If non-citizens are included in the census the number of jerrymandered Democrat districts will explode and Republicans will be a permanent minority. It happened in California and Virginia and it can happen nationally very quickly.

Now we know that the bigger game here is not that many of these illegals will vote in the elections. The even bigger game is to give the communist communities where they live more representation after the census. This is even more damaging than the illegal voting.

Amendment XIV

“Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside...

“Section 2. Representatives shall be apportioned among the several States according to their respective numbers
,counting the whole number of persons in each State, excluding Indians not taxed....”

Sorry but you are incorrect. The census clause states the number of free persons - not citizens. While I have no problem with limiting the census to counting citizens, it would require a constitutional amendment.

From Section 1, it’s a census of every permanent resident fully subject to federal jurisdiction who is not an untaxed American Indian.

From Section 2, the apportionment is by citizenship, however.

Generally, if you aren't a citizen you shouldn't be here permanently unless there are legal documents stating otherwise. Yes?

To maintain the original basis of apportionment by residents, the first sentence of Section 2 of Amendment XIV should have been written as:

Representatives shall be apportioned among the several States counting the whole number of persons in each State, excluding Indians not taxed.

Alternately, Sections 1 and 2 could have been reversed to retain the original basis of apportionment by residents, but they weren’t.

Amendment XIV was rushed though despite warning of potential problems.

A citizenship question on the census form is inherently worthless because many illegals would lie.

The federal government knows of births, deaths and naturalizations from governmental records. It doesn’t always know which state a citizen is in. Some citizens are outside the USA.

But the 14th amendment section 2 requires a count of citizens in order to assess penalties against states that abridge their citizens' right to vote.
