A court in Barcelona cleared five men of sexual assault charges on Thursday after saying the crime did not fit the legal definition of rape because the unconscious teenage victim didn't fight back.
Under Spanish law, a sexual attack can only be classified as an assault or rape if the perpetrator uses violence or intimidation. Because the 14-year-old victim was unconscious, the five were convicted of a lesser charge of sexual abuse.
The case renewed pressure on the government to reform the law and specify that any sexual act without consent is an assault.
The Barcelona court sentenced the five men to 10 to 12 years in prison, despite the prosecution arguing they should be charged with assault.

They all got 10-12 years... this is an outrage over the fact they didn’t get an “assault” or “rape” conviction because of the letter of the law.

Remember Jared admitted to sex with multiple underage girls, and got 15 years with a chance at parole in 10 I believe.
Assuming sexual abuse of a 14 yr old gets more than a slap on the wrist, I’m good with this.
What’s a 14 yr old doing being unconscious through multiple rapes?. Even being in a situation where that could happen?

I looked up what the average sentences for rape were and most tended to be 5-10 years. In the US the avg time served was about 1/2 the sentence so it would be 5-6 years. I am not saying I agree with the judgement, but the sentence as is is more severe than most rape sentences in the world.
I would not mind mutilating the POSs, but that is just me.

Spain is not backwards. But, being Castilian - Im not a fan of Barcelona. They want out so badly, let them go.
My thoughts exactly. 10-12 years probably typical for rape and isn’t far off average second degree murder charge in the US.
Back when sex basically “ruined” a woman, I would have agreed with mutilation. Today? Nah. Today it just makes them “strong, independent” women. 5-20 years depending on the severity and age seems appropriate to me, so 10-12 is in line.
Hey, theyll get out earlier, and create more work for lawyers and judges. Its all an attorney jobs program.

Every one of these defendants got between 10 and 12 years for what they did.
The “activists” are angry because they didn’t get an explicit “assault’ or “rape” conviction because of the letter of the law, which states assault or rape requires an explicit coercion, physical or otherwise.
Remember Jared admitted to sex with multiple underage girls and got 15 years here in the states with a chance at parole in 10 if memory serves.
The outrage is over ‘feelings’ not substance.

If she were my daughter, I’d have to hunt down and remove from the gene-pool each and every one of these miscreant rapist monsters. I would, however, have to knock them unconscious first, before rendering them into a room temperature state. Also, I’d bring a shovel.

By that standard a murderer can get off by saying the victim didn’t object to being killed.
