California Governor Approves Broadest Gun Seizure Laws In US

Democratic California Gov. Gavin Newsom has approved some of the strictest gun laws and gun seizure powers in the U.S. Friday, signing into law 15 different pieces of gun legislation.

Newsom has reinforced a “red flag” law that enables educators, employers and co-workers to inform on gun owners and request that a restraining order be placed on them — if they are believed to be a danger to themselves or society, according to the Associated Press.

The bill was deemed to be to extreme even for Newsom’s predecessor, former Gov. Jerry Brown, who was also an enthusiastic advocate of gun control. Brown vetoed the legislation twice.

Today’s legislation also included a bill that would make these restraining orders last for up to five years. Judges may also issue search warrants when the restraining orders are mandated so that authorities may enter a private residence to seize guns, per AP. (RELATED: Gavin Newsom Rips Trump To The U.N.)

“California has outperformed the rest of the nation, because of our gun safety laws, in reducing the gun murder rate substantially compared to the national reduction,” Newsom said as he approved the legislation, AP noted. “No state does it as well or comprehensively as the state of California, and we still have a long way to go.”

Newsom also encouraged people in the state to “tune in as we sign 15 bills … to help prevent gun violence in CA.”

The governor claimed that gun homicides declined twice and fast as the national average between 1993 and 2017.

Co-workers who want to have another employee’s guns seized must demonstrate that they have “substantial and regular interactions” with the gun owner they are fingering. Employers must also agree with the employees assessment before a restraining order is issued and accusers must complete a sworn statement that explains why they believe the gun owner should be restrained.

The American Civil Liberties Union (ACLU) did not support the bill because the legislative watchdog believes it “poses a significant threat to civil liberties” as gun owners can be subject to a restraining order without even being told they are under investigation, AP noted.

Also, the ACLU argued that co-workers might not be the ideal person to judge a gun owner’s potential danger because they could well “lack the relationship or skills required to make an appropriate assessment.”

The new laws will be effective Jan. 1, 2020.

When you've gone too far Left for the ACLU, you know you're really out there.

I doubt it. Much as I love my state, most Californians will respond to this infringement of the 2nd Amendment with a shrug and a “Meh”.

This has very little chance of passing a Supreme Court review.
Violates 2nd Amendment, Illegal search and seizure , probable cause and admission of hearsay evidence.

NOT GOOD ENOUGH!

What about total strangers and the staff of gun control organizations! They need to be able to red flag everyone!

Pardon me for pointing out that less than 1 in 4 colonists supported separation from the UK during the AWI.

Nonetheless GEN Washington’s army won.

Disarm this Newsome-Soon to be California's second recalled governor:

"A free people ought not only be armed and disciplined, but they should have sufficient arms and ammunition to maintain a status of independence from any who might attempt to abuse them, which would include their own government.” – George Washington

“No free man shall ever be debarred the use of arms…What country can preserve its liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance. Let them take arms.” – Thomas Jefferson

“I ask, sir, what is the militia? It is the whole people. To disarm the people is the best and most effective way to enslave them.” – George Mason, Virginia Convention to Ratify the U.S. Constitution, 1788

“They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety." –Benjamin Franklin, Historical Review of Pennsylvania, 1759

Anti gun people think that just someone owning a gun makes them a threat to society.

The left pushes these laws because they know that owning a gun is a threat to tyrants. Their’s not much concern for society.

I have sympathy and pray for our conservative friends in California, of which there are many.

Their government is going to make law-breakers out of many of them.

20 years from now, if, maybe. SCOTUS sucks on 2A freedom.
Trump may go for similar red flagging. I don’t trust him or SCOTUS on gun rights.

“...Nonetheless GEN Washington’s army won...” [TMN78247, post 26]

No it didn’t.

The Continental Army merely avoided total annihilation until American diplomats secured an alliance with the French. Spain came in soon after, then the Dutch. Faced with a wider conflict against major Euro powers, the British lost interest in hanging onto the original 13 colonies.
