A judge told federal prosecutors on Monday that they needed to charge former acting FBI Director Andrew McCabe or stop investigating whether he lied to authorities.
Judge Reggie B. Walton said at a hearing that if prosecutors don't make a decision by Nov. 15, he would order the Justice Department to release internal FBI documents connected to McCabe's ouster, The Washington Post reported, citing a court transcript.
“I would send this message to those in positions of authority in the U.S. Attorney’s office and the Justice Department ... that I will not condone further delay,” he reportedly said, adding that the case “is just dragging too long.”
“You all have got to cut and make your decision. It’s not a hard decision, and I think it needs to be made. If it’s not made, I’m going to start ordering the release of information because I think our society, our public does have a right to know what’s going on," said Walton, a George W. Bush appointee who once presided over the Foreign Intelligence Surveillance Court.

I think it’s reasonable, a question of due process and speedy trial. Can’t have the government running endless investigations on a single person or single event (or series of events).
On the other hand it could backfire on the judge and McCabe. They may decide to drop every conceivable indictment on him if their hand is forced too soon in some effort to get him to roll.

Our country is at full out war. When is the last time one of our political parties joined with masses of bureaucrats in all out war to oppose the President and the people. I can’t remember any time in US history when we were at an all out political cold war like this. I mean, the War Between the States was a declared shooting war much like the Revolutionary War. But for one of our party’s to join with unelected bureaucrats to undermine the people and the government’s authority — it is unprecedented.
These are dangerous times. We are on the edge of losing our nation. God Bless President Trump for fighting for us.

Investigators have the responsibility to investigate and if it takes time so be it. A judge has no business cutting it short.
Also amazing considering the endless investigation into Russia Gate - there was never any hesitation by the court to allow a never ending investigation that had ZERO evidence to start it in the first place.

Judges don’t get to to tell the FBI who they and cannot investigate.
That is certainly relevant.
I seem to recall that O.J. Simpson's attorneys saw the benefit of rushing the prosecution so they waived some processes in order to expedite the trial. They succeeded in making the prosecutors appear pretty inept in many areas.
McCabe's lawyers may drive the prosecution to file early and often, resulting in a situation in which McCabe is sure to be convicted of some charges.
If the Trump prosecutors can't be confident of a conviction then they shouldn't be threatening one.
The problem seems to be that the actions taken by many of the anti-Trump conspirators were actions they were authorized to take except for having insufficient justification that they lied about.
A problem I see is that people like McCabe aren't terrified enough to believe that they could die in prison. The Felicity Huffman / Lorie Loughlin situation illustrates what I am talking about. When Loughlin saw Huffman draw two weeks of hard time and recognized that the size of her bribe was perhaps 30 times larger, maybe she did some simple math and didn't like what she saw.
It was a judge who smelled a rat who sentenced the Watergate burglars to heavy sentences, knowing that they were covering up their true motives for having committed the crime. The need to keep the burglars quiet resulted in some of the crimes of Watergate.
That is why Trump's people need to really slam somebody for something so that the other conspirators will see the need to jump ship. Maybe that is why we are hearing about some of the people who mailed stuff to Hillary on her private server. What did they know and when did they know it?
Personally, I think that McCabe should be charged and I think that the charges should be extreme. He needs to be made an example of. I want him to seriously look at spending the rest of his life in prison without any pension for his family.
At that point if he wish to seek a plea deal and flip on Obama and the others, then so be it. If he doesn’t want to flip, then make an example out of his for others to see the price of treason.
These are non coup related charges McCabe is facing. IRC it’s about leaking during the obama admin. Even if he is indicted for that it will be a sidebar to the main story.
If I remember correctly, this is a Freedom Of Information Act (FOIA) case where the DOJ was allowed to withhold otherwise releasable documents while they made a charging decision. The Judge is simply telling the DOJ that he is not going to delay the right of the document requester any longer simply because the government can’t make a charging decision. They can still take whatever time they want to make the decision, they just can’t keep the documents secrete any longer.
