Chinese traveler found with armor at Detroit Metro returned to China, customs says

Customs and Border Patrol agents have returned a traveler to China after finding weapons in his luggage, officials said Friday.

A Chinese national arrived at Detroit Metropolitan Airport from Beijing on Aug. 18 and declared that he wasn’t carrying any prohibited items, said agents with Customs and Border Patrol.

During an examination of the traveler’s luggage, officers discovered undeclared ballistic armor and other tactical apparel, they said. Agents also discovered evidence that the traveler had a collection of weapons at his U.S. residence, including high capacity magazines and bump stock devices.

Investigators searching his U.S. residence found “a significant cache of firearms and other regulated paraphernalia,” they said.

Agents determined the passenger was inadmissible to the United States and returned him to China.

Legal residents can purchase firearms in the U.S.

ATF Form 4473 instructions:

Question 12.d. Immigration Status: An alien admitted to the United States under a nonimmigrant visa includes, among others, persons visiting the United States temporarily for business or pleasure, persons studying in the United States who maintain a residence abroad, and certain temporary foreign workers. These aliens must answer "yes" to this question and provide the additional documentation required under question 18.c. Permanent resident aliens and aliens legally admitted to the United States pursuant to either the Visa Waiver Program or to regulations otherwise exempting them from visa requirements may answer "no" to this question and are not required to submit the additional documentation under question 18.c.

Question 13. U.S.-issued Alien Number or Admission Number: U.S.-issued alien and admission numbers may be found on the following U.S. Department of Homeland Security documents: Legal Resident Card or Employment Authorization Card (AR# or USCIS#); Arrival/Departure Record, Form I94, or Form 797A (I94#). Additional information can be obtained from www.cbp.gov. If you are a U.S. citizen or U.S. national then this question should be left blank.

bump stock devices. Suggests to me this one is not a spook. Maybe a little mental I don’t know.

Curious that the ATF didn't want to test their new ruling on bump stocks being machine guns by prosecuting the guy instead of deporting him.

Possession of a bump stock is possession of an unregistered machine gun.

Your response means the alien will Not be sold a firearm until investigated by the atf & b.

I would suggest that would be No in a sane world.

I went to my mgr's and banned myself from a Chinese National's home due to suspect activity.

I own several weapons and I never filled out a form 4473. I only buy from private sellers. Not a loophole, just legal where I live.

Well, I guess as a foreign national, he got the firearms on the black market,

Since he has a residence here in the U.S., he is likely a legal alien with either a H1B work visa or green card. If that's the case, it is perfectly legal for him to purchase firearms.......

Seems to me the only law he broke was not declaring the body armor, and to be perfectly honest, I never knew such items had to be declared at customs either.

Since most stuff is made in China these days, it was probably cheaper to purchase it there than here.......LOL!

Stupid part of it is that there is nothing stopping him from buying it once he got here. Body armor is not regulated in most places in the US.

In practical terms you are correct, but legally if he’s a foreign national on a visa not a Green Card, ITAR still applies. He could not, for instance, purchase ITAR restricted RF chips or Krytron switches.

If he found a dealer who did not check for citizenship then yes, he can buy ballistic armor, but the transaction would not be legal.
