I thought it was as Why Dear, and last time I was in court I told the judge that I got enough of that at home......

Wish Paul Harvey was here to give us the rest of the story...did the guy throwing the ball cross the line and make a point of doing damage or was it an actual game of dodge ball? What was the supervision? Too many unanswered questions to come down on either side...but FReepers will do so any way and half will exult how they were right if it ever becomes clear what really happened...the rest will wait for their jump the shark lottery ticket to win something.

There, I feel better.

Gimmy a break. You can’t kill with a ball.. These are rubber balls and it’s a game.. Not for sissies!

. . .and it’s a game.. Not for sissies!

Since when is a game of dodgeball a determining factor of the degree of one's masculinity. There usually isn't an option to play or not to play in a physical education class or for that matter supervised playground activities. Let's not forget also those special ed students and mildly disabled who are included in most school physical education programs with accommodations provided on their IEP's.

Maybe not YOUR version of the game. It sounds like your version of dodgeball should require helmets. You may need to brush up on some school law.

so more information:

https://www.msn.com/en-us/news/crime/charge-dropped-against-10-year-old-who-injured-classmate-in-dodgeball-like-game/ar-AAF825r?ocid=spartanntp

“The incident happened when students were playing a game called tips, according to Lindley’s Facebook post. Tips is similar to dodgeball. but instead of throwing the ball at each other, children toss the ball into the air and then jump up and catch it.”

Prosecutors said that the incident between Lindley’s son and the other boy happened after the students had stopped playing the game. Lindley’s son allegedly “took the ball and intentionally threw it with force” at the other boy, Worthy said in a statement Wednesday.

So, the form of the game sounds like it is very unlikely to result in a hard hit to the head from a ball...and in any case, the incident was apparently not actually part of the game play.

If that’s true, it is an assault, although ten-year olds aren’t often held responsible.

I call it a stupid accident...when I was 10 we had a game called “Kill the pill” or the more offensive term “Smear the Quire.” the game consisted of throwing a football into the air and some one catching it while everyone else tried to tackle the kid with the ball. we had all sorts of injuries and today I am sure that you would have weak willed parents who’s son broak there arm playing the game calling it assault. I don’t think any parent back then gave it a second thought when a kid playing the game got hurt. it was just a part of growing up.
