Prosecutors in France did not include the aggravated element of a hate crime in indictments of three men who allegedly singled out a Jewish family for a burglary at their home, JTA reported on Tuesday.
In the 2017 incident, the suspects are accused of breaking into the Paris-area home of Roger Pinto, the president of Siona, a group that represents Sephardic Jews.
The attackers, two of whom were wearing masks, beat Pinto’s son and wife in the home in the northeastern suburb of Livry Gargan. One of the burglars said “You Jews have money,” according to the family members.
French police arrested five suspects in connection with the incident in December of 2017. Prosecutors said at the time that the suspects would be charged with a home invasion with aggravated elements of a hate crime. […]

Hate Crime law is by far the worst type of law — it can never be applied evenly/fairly.
Hate Crime law is tantamount to adjudication by self-serving opinion.
I don’t care if they didn’t add hate crime charges, just send them to the guillotine for their cruel actions against the family.

Ironic, considering they convicted Brigitte Bardot of hate speech.
This is why hate crime laws are such a disaster. This aspect of prosecutorial discretion seem to occur fairly often.
These days, it’s only a ‘hate crime’ if the target is moslems.

Murdering a Jewish woman because she is Jewish and you hate Jews is not a hate crime, but spray painting a mustache on a picture of a an obnoxious lesbian football player is a hate crime that has the personal attention of the mayor of New York City pushing for prosecution to the fullest extent of the law. The spray paint artists will see more jail time than the murderer

"Hate" crimes are irrelevant in most cases, though it's a legitimate a factor in sentencing. What will be interesting to see will be the charges and eventual resolution of the case. Home invasion is a serious crime even in France. And hatred of a particular group is relative in sentencing, presuming a conviction. You might recall the trial of the palestinian who shot up a Jewish center in Seattle, killing a pregnant woman and wounding 4 more I believe. Copious evidence of premeditation, including training. First trial, acquitted on one count and hung jury on the rest. No harm, no foul. Not realizing his jail phone conversations were recorded the moron bragged to his mom of his intent in this crime, and intent to continue should he be freed, which did get him convicted second time around.
Hate crime laws are state sponsored terrorism against the ‘unworthy.’
