[Oregon] Senate Democrats to bill Republicans $3,500 each for walkout

SALEM — Senate leaders say they are preparing to invoice 11 Republican senators for fines associated with a June walkout, after determining a plan to dock their pay wasn’t legal.

The invoices would total $3,500 for each senator. The total includes $500 per day for seven of the days Republicans refused to show up for a floor session, Oregon Public Media reported .

Carol McAlice Currie, a spokeswoman for Democratic Senate President Peter Courtney, said this week bills will be sent to each senator who missed work. “If they refuse to pay, they will be sent through the regular debt collection process,” she said.

Dallas Republican Sen. Brian Boquist, who believes the fines are illegal, already sent a check to Courtney for $3,500 along with a letter indicating he was paying to allow him to “seek remedy in state and federal court.” The walkout was a way to halt a vote on climate legislation. The measure aimed to dramatically reduce greenhouse gases by 2050 by capping carbon emissions and requiring businesses to buy or trade for an ever-dwindling pool of pollution “allowances.” California has a similar program.

Republicans called it a job-killer and wanted it sent to voters for final approval.

Democratic leadership said during the walkout that the plan had lost the support it needed among Democrats to pass and it died in the final days of the legislative session.

Democrats have suggested there is precedent in other states for such fines.

Personally i would get the cameras around me and burn the invoice.

The wisconsin senators who fled to illinois and minnesota and iowa to escape voting on bills they were not going to win weren’t fined.

Ex post facto penalties are illegal pretty much everywhere. This won’t hold up in the first court it reaches.

These fines are a “bill of attainder” which is expressly forbidden under the Constitution. If there is no law proscribing punishment for an action before it occurs then it is unconstitutional to do so after the fact.

Here is the definition:

A bill of attainder (also known as an act of attainder or writ of attainder or bill of pains and penalties) is an act of a legislature declaring a person or group of persons guilty of some crime and punishing them, often without a trial.

And here is the section of the Constitution of the United States, Article I, Section 9, paragraph 3 that state that: "No Bill of Attainder or ex post facto Law will be passed."

We’re always bitching that the GOP doesn’t fight back.

Restricts only the federal Congress, not state legislatures, as here. The Oregon constitution is controlling.

You couldn’t be more wrong if you tried. Did you even read the Constitution before you pronounced your nonsense?

Article 1, Section 10: “No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.”

Article 1, Section 9 applies to the Federal Government, Article 1, Section 10 specifically limits the States and applies to the States by its very terms. The “no bill of attainder or ex post facto” prohibition applies equally to the States and the Federal Government.

In fact, prior to the Bill of Rights, these are the only two individual liberties that the original Constitution protects from both federal and state intrusion.

James Madison outlined: “Bills of attainder, ex post facto laws, and laws impairing the obligation of contracts, are contrary to the first principles of the social compact, and to every principle of sound legislation.”

This "Constitution" thing of which you speak. It doesn't apply to Democrats, the Oregon House, the city of Portland, the Mayor/Police Commissioner of the city, or the Chief of Police. They do not recognize it, just as they do not admit that Trump is "their" president.

Wait 'til next November, and he wins another "Constitutional" election. That will be interesting.

Well, the only possible remedy is to bill every Democrat $75000 for being a f***ing moron, then send the unpaid bills to the regular debt collection process.
