Trump asserts executive privilege to block release of full, unredacted Mueller report

President Trump asserted executive privilege on Wednesday in a bid to protect Special Counsel Robert Mueller’s unredacted report and underlying documents from subpoena by the House Judiciary Committee.

The president’s move came after the Justice Department, late Tuesday night, requested that the House Judiciary Committee postpone a scheduled vote on to hold Attorney General Bill Barr in contempt of Congress for defying a subpoena to provide the Mueller files to the panel. The Justice Department warned that if the committee did not postpone the vote, the attorney general would recommend that Trump claim executive privilege over the materials.

On Wednesday, the White House did just that.

This is Truly the greatest President since George Washington. In what was absolutely demanded of our president he has stopped the witch hunt. The Mueller report IN FINAL. There will be no more fishing expeditions by a shameful partisan congress hell bent to overthrow the election. Well HELL NO!! No access to Mueller!! ZERO!!This is a happy happy day!!

That was my thought when they first called for the unredacted report. They do have a secondary goal of persecuting Trump supporters however they can be identified. That is also at least part of the reason that grand jury info may not be made public as per federal law.

Why in the HELL don’t they just release the damn proof of the spying on the Trump campaign and the then framing Trump for Russian collusion, I just don’t understand WHY they just don’t drop The whole damn mess!!!

Not Executive Order (EO), Executive Privilege.

The argument is that the Mueller report was an internal DoJ investigation, wholly contained within the Executive branch. Essentially, it was ALL for the purpose of executive advice. That makes it privileged communication.

The corollary argument is that executive privilege is not "waived" when it involves internal communications. Executive Privilege is a protection against co-equal branches of government. The President is entitled to private counsel in order to conduct his job, and Congress is not entitled to that information.

The counter argument is that Congress has legitimate oversight responsibilities over things that Congress creates or confirms. Therefore, the DoJ being a creation of Congress and the Attorney General being a confirmed officer, Congress can demand access to products of those departments.

Where this argument ends is with White House aides who are NOT creations of Congress, but are a natural part of the Executive branch. That's why former White House Counsel Don McGahn is defying the Congressional subpoena on executive privilege grounds. Congress has no oversight authority on White House aides.

Apologies if this has been posted. Listened to Rush last week and he stated the unredacted report has been available in a secure room to all in the house and senate, with the caveat that it can only be viewed by signing-in and cannot be removed or copied by the viewer. It had been several days since the report was made available and only 2 legislators viewed the document...both were Republicans.

If true, then Trump may have waived the executive privilege with respect to the unredacted report.

The report made available in the reading room was “less redacted”, but not completely unredacted, so no, he didn’t waive EP to the unredacted report.

We JUST GOT a functional attorney general for one thing - that post was essentially vacant for 2 years of history. 2nd, what "proof" exactly - the stuff that has been batted around on FR and Sean Hannity? There has been no real official effort to seriously delve into that until recently - piecemeal to no effort on that for 2 years, and there is work that is just getting started. Finally you simply don't "drop the whole mess" into the public domain in the midst of an investigation - it's a mass ball of yarn that has to be untangled and indications are it may stretch further back in time than 2015.

Mainly because the "proof" doesn't mean anything outside of a court of law. The President or designee can say Halper is proof of FBI misconduct or Mifsud is proof of intel community misconduct. But outside of a court, Comey and Brennan will argue those operations were part of an investigation. The proof can only come from a Barr investigation of FBI and intel community activities. E.g. who authorized the sting operation on Papadop starting before he worked for Trump? Who hired Mifsud? Who instructed Turk? Without a proper investigation of the origins, we have nothing.

But with investigations and plea deals admitting specific misconduct then we will have proof.
