Judge to Trump: I can compare you to the KKK but you can’t criticize me

You cannot criticize me ever, but I can criticize you. Even though you’re up for reelection, you have no power, but I am the final say on all matters, even though I am unelected. I can disobey higher courts but you can’t push back even against a lower court. If you don’t like it, then you are a member of the KKK.

Who am I?

Well, a federal judge, of course.

Last week, a radical federal judge went on a tirade against President Trump, ironically, criticizing him for criticizing outlandish rulings by federal judges. Carlton Reeves, an Obama-appointed judge in Mississippi, delivered an unprecedented personal attack on the president. Typically they wait until retirement for such tirades, but Reeves, who has been prone to such tirades in his written opinions, let loose on what he called “the great assault on our judiciary.”

If you think that lower courts will accept Supreme Court rulings they disagree with, let this speech from Reeves be a warning.

Reeves also said, “When lawmakers say ‘we should get rid of judges,’ you can hear segregationist senators, writing bills to strip courts of their power.”

Thus, he is comparing a power vested in Congress in Article III Section 2 to make regulations and exceptions to the jurisdiction of the courts to the KKK.

Reeves believes that anyone who disagrees with him is assaulting the Constitution, but he doesn’t believe in the constitutional constraints and checks on his ability to implement his world view unilaterally.

How do you remove an unelected federal judge? He can only be impeached for "high crimes and misdemeanors" by politicians who would never have the stones to do it?

Judges can be removed by ‘bad behavior’, as defined by the House and Senate.

There are also ways within the Judiciary Branch to neuter rogue judges.

Get a transcript of his remarks and report him to the local attorney grievance committee and local commission on judicial conduct.

The day will come when the Democrats disregard for the rule of law will convince the Republicans to do the same, and it will not be a pretty picture.

Time for Trump to double down and start calling for impeachment of the judge. It’s been done before and it’ll happen again, just ask Alcee Hastings.

If you reject the judges claimed authority, he has none.

Conservatives need to learn to stand up or risk losing ALL of their freedoms.

The only Fed Judge I can ever recall being impeached was Alcee Hastings, who turned around and stuck it in their face by getting himself elected to the House for ten terms.

Congress has the power to control the federal judiciary. Proper vetting of judges when they are appointed is the first. The Senate should not be approving activist judges. Impeachment is another power. Activist Judges who are not administering the law should be removed. Congress has failed miserably in failing to remove unlawful or incompetent judges.

The Constitution provided for only one federal court, the Supreme Court. The Constitution left it to Congress to provide for lower courts. Congress has the power under the Constitution to define the jurisdiction, role and scope of the lower courts. Congress today can pass a law to restrict the power of lower federal court judges to halt the enforcement of laws and regulations. In addition it can forbid lower courts from declaring laws unconstitutional.

We must also remember the power of the Supreme Court to declare laws unconstitutional was not given the Judicial branch in the Constitution. In Marbury vs. Madison the Supreme Court decreed itself as having the power. Congress could just as easily decree the Supreme Court does not have that power.

Likewise for much of our history the federal courts did not have superiority over the state courts. The power of the federal courts to overturn state court decisions was another power seized by the federal judiciary, not granted to it by the Constitution or through legislation.

The excesses of the federal courts exist due to the failure of the legislative and executive branches to act as checks on the tyranny of the black robed judges. Unfortunately the nation today is politically polarized and one side (the socialist Democrats) use the courts to create laws and outcomes they cannot realize through the legislative process. With Congress divided as it is, there will be no legislative action to reign in the courts.

The only way in today’s environment to restrain the tyranny of the federal bench is a Constitutional Amendment resulting from a convention of the states.

Dig into his background; find the dirt and filth. It’s there, somewhere. Expose him publicly. When enough people become enraged, he’ll (maybe) resign.

Interestingly another Fed Judge from Mississippi was impeached and convicted: Walter L. Nixon, U.S. District Court for the Southern District of Mississippi.
Impeached by the U.S. House of Representatives, May 10, 1989, on charges of perjury before a federal grand jury; Convicted by the U.S. Senate and removed from office, November 3, 1989.

Of course his crime was perjury. This clown is a pompous a hole lefty.
