Judge deals blow to 'Trumpcare' plans

A federal judge has struck down a rule letting individuals and small businesses pool together to buy health insurance, threatening a program encouraged by the Trump administration that was created as an escape hatch from high Obamacare premiums.

The ruling, issued Thursday by U.S. District Judge John Bates, a President George W. Bush appointee, came after 11 states and the District of Columbia sued saying that the rules violated Obamacare and the Employee Retirement Income Security Act, or ERISA.

Bates agreed, concluding in his opinion that the rule, issued by the Department of Labor, was "clearly an end-run around" Obamacare. He also stated the Trump administration didn't have the authority under ERISA to change the rules.

It was not immediately clear whether the administration's up-and-running alternatives, know as "association health plans," would still be allowed to operate. Bates in his ruling asked the Department of Labor to state whether any part of the rule could still stand.

The ruling is the latest blow this week to President Trump's healthcare agenda. A judge struck down Medicaid work rules earlier this week, and many Republicans have said they do not wish to come up with a replacement plan after the administration in a surprise move asked an appeals court to fully invalidate Obamacare.

WTF?!

Contract law is THE basic right that all people have in this country - if this stupid judge doesn’t understand that we have the right to band together (y’know... like a UNION) to negotiate better insurance rates (like all corporate groups do) then he should be impeached immediately.

This is nonsense and a stupid ruling and further proves that Obamacare is UNCONSTITUTIONAL.

Welp, the stinkin' judges "orders" can go down the toilet the same time the Obamacare law gets dumped....since Robert's "tax" gimmick doesn't work without the individual mandate. Good riddance, to both.

The good news is that the "judge" who struck down Medicaid work rules in Arkansas and Kentucky may have p*ssed all over his own shoes with that decision:

And there’s still potential for political fallout in the state [Arkansas]. When funding the state’s Medicaid expansion, the legislature made clear that a work requirement was the price to be paid. This ruling comes as the legislature is again considering whether to maintain funding for Medicaid expansion. The state senate approved the needed funding on Wednesday, before the ruling was issued; now the funding bill heads to the house, where it needs a three-quarter majority to pass.

If state lawmakers decide to roll back the expansion, the shock to the state’s healthcare delivery system will be enormous...

If the Arkansas House refuses to fund the expansion again, the Federal judge will just over-rule their vote and require the state of Arkansas to fund it.

Just like any good old-fashioned black-robed authoritarian clown would do...

Exactly. People can say what they want about Coulter, but I remember reading/hearing from her that two different versions of the law were passed by the House and Senate. And that is not allowed. They have to pass the bills, meet for compromise in committee(if needed) and then vote on the compromised legislation, and then send it to the White House.

Additionally, didn’t the House just remove the language of a bill that had already passed and inserted obamacare to give the impression that it passed, when in fact it didn’t?

You need to be the President’s Senior Adviser to writing TrumpCare.

Getting employer’s and corporations out of the business would fix the problem in 6 months. If I’m not mistaken, Pelosi is the one that handed the tax breaks to corporations, when it comes to health insurance, while taking it away from the individual. If an employer wants to provide a stipend to an employee for insurance, good on them.

This is evident, as we type, go a doctors office and tell them you’re paying cash. The price for services falls through the floor.
