I don't think that's going to fly -- even in the Ninth Circuit. The defense budget is $700 billion.

Meanwhile the ‘wall’ keeps going up...just ‘finished’ another 20 Miles on the New Mexico border! .....as long as they’re in litigation the work on building cannot be stopped as I understand it.

Did Mexico sue him? How about Honduras? Anyone else? This is getting outrageous. Our President can’t even go to the restroom without getting sued. I am getting sick and tired of the commie a**holes....

Just an old oilfield hand in west Texas but don’t you have to be able to show you were or will be damaged to file suit? Since the Fed’s have a 60 or 90 ft right away with an existing fence in place from El Paso to the west coast I see no damage there. How does fixing or rebuilding an existing fence create damage? Texas is a whole different story with mostly private land that goes to the waters edge, the actual border line is the middle of the river. This is why I’ve always said they’ll never fence of the Texas southern border.

Its my understanding Trump has around 5b for wall money (1.4b budget bill and 2-3b other money derived for other statutes he has already cited) not including the emergency funds he intends to claim. So while these guys fight over the emergency, the wall will be getting built. Once the courts have decided the emergency declaration is in fact 100% acceptable, the military and billions more will pour in to supercharge the walls progress.

So, people who voted for Trump to build the wall will turn against him and vote for a lying democrat who KEPT Trump from building more than 55 miles? I have a hard time buying that. The only way I can imagine my NOT voting to reelect Donald Trump is either that he is not on the ballot or I am not able to vote and I am one who thought just a few years ago that the idea of Donald Trump being president was absurd.

I don’t think a state can sue unless the wall is actually being built within its borders. And Trump would have to be using the unallocated funds which he has not yet dipped into. So these states have no standing.

The ONE WORD that REQUIRES Donald J Trump to Declare a National Emergency on the border if Congress failed to follow through on their own border bills which they have not done:

TEXAS

Texas has a Supreme Court right under federalism under Article 4 Section 4 of the US Constitution as well as by Congressional Treaty (1845 Joint Resolution of Annexation of the Republic of Texas to the United States of America) to counter sue the states that do not wish to defend the border. Clearly Texas has been invaded. Statistical records from DPS proves this beyond a shadow of any doubt.

Texas has the superior interest over the 16 states that have sued the Executive Branch over the national emergency.

If Trump does not declare the emergency then the United States is in violation of its duties under the 1845 treaty and Article 4 Section 4 of the US Constitution.

The 16 states that have sued Trump have no standing on border matters. They have no authority whatsoever to challenge Executive Action on the border. If they choose to withhold support of the border then Texas must sue immediately to recoup damages including DPS wages for law enforcement.

Does Trump and his lawyers get a televised opportunity to make their legal case? I would love for this to be public and we can hear the arguments as how 30 million invaders constitutes a national emergency.

The attorneys general from Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon and Virginia joined California in the lawsuit. 16 states.
