Senate has votes to formally disapprove of Trump emergency declaration, Tammy Duckworth says

Sen. Tammy Duckworth, Illinois Democrat, on Sunday said she believes there are enough votes in the Senate to pass a resolution disapproving of President Trump’s recent emergency declaration the White House says will allow him to tap unspent money to construct a border wall.

“I think we do,” Ms. Duckworth said on ABC’s “This Week.” “Now, whether we have enough for an override and veto, that’s a different story.”

“But frankly, I think there’s enough people in the Senate who are concerned that what he’s doing is robbing from the military and the [Defense Department] to go build this wall,” she said.

Under the National Emergencies Act, Congress can pass a resolution disapproving of Mr. Trump’s emergency declaration.

I wish the turtle would declare a nuclear option and bring this resolution to the floor for a vote. Then we would see who the traitors are in the Senate.

I've never understood what the "nuclear option" is. Could you kindly explain it to me (and others)? How does it work? Thank you in advance.

I've never understood what the "nuclear option" is. Could you kindly explain it to me (and others)? How does it work? Thank you in advance.

The "nuclear option" is a parliamentary procedure that is toxic because it "games" the system, so to speak.

The Constitution gives each chamber the power to create its own rules. One rule that the Senate has is that they have to vote to change the rules. Any vote taken in the Senate requires cloture, which is a vote to end debate and move to the final majority vote. Cloture requires a "super-majority" to pass, in this case 3/5ths or 60 votes. Therefore, a vote to change the rules requires 60 votes to end debate, and then 51 votes to pass the rule.

The "nuclear option" is a parliamentary trick to bypass the regular order described above. Essentially, one Senator makes a point of order declaring something to be true, such as that the filibuster no longer applies to budget resolutions but still applies to new legislation, for example.

Once the point of order is made, the Parliamentarian rules on the point of order. The Senate then votes to accept or reject the ruling of the Parliamentarian, which is a majority vote not requiring cloture, thus bypassing the 60 vote requirement to end debate. The Vice President in his role as President of the Senate, can override the Parliamentarian's ruling if necessary.

They need 2/3 vote or 67 senators to pass a resolution. However, I don’t think a resolution can cancel a Presidential proclamation of Emergency.

It’s the House of Representatives run by perverts which is the same party that Duckworth’s belongs to that decided not to fund prevention of the drug and disease criminal invasion of the US caused by open borders. Not the President of the United States who is trying to stop it and is forced to do so by any means available

Yes, she was in the Army Reserve and was a chopper pilot.

She was a copilot in UH-60 that was shot down in Iraq and lost one leg and part of another.

Like you I don’t like bad mouthing veterans, she gave a lot for the nation in the military but I don’t understand her leftism as a senator.

I don’t understand that either.

She’s misguided on that front, but I respect her service and loss very much.

I sure hate to see here go against the service by being a Democrat. They literally hate the military all too often.

Does “disapprove” have any legal or enforcement effect?

If Congress passes a resolution to rescind the declaration AND overrides Trump's veto, then, yes, it certainly does. The emergency wold be cancelled.

The traitors who vote against President Trump should be expected to lose at primary elections. Every one of them.

I wouldn’t want to serve in battle with any one of them.
Hopefully, none will ever be in the military.
