Who knows? These rumors are always such wild cards. They stir up a frenzy and then turn out to not be true. The only way she is stepping down is if she is going to die within the next month. Otherwise, she will hang on tooth and nail to avoid giving Trump another pick.

There is nothing but Senate tradition that mandates the Bide rule. So I highly doubt that McConnell or Graham would pass on the chance to fill a Supreme Court seat in 2020. But I also think their rank hypocrisy would cost the Republicans that November so if the opportunity arises then they had better make their pick a good one.

Last year, I was talking to an acquaintance who is a former clerk of Thomas’s who is still in touch with the Justice. He predicted that Thomas would resign if the Republicans held on to the Senate, and that his replacement would be Jim Ho, currently on the 5th Circuit.

That conversation was right after Kennedy retired, and he correctly predicted that the appointee would be Kavanaugh (which he said was due to a gentleman’s agreement between Kennedy and the administration).

I don’t take it as gospel, but the source certainly has more inside knowledge than I do, and it certainly makes a lot of sense for Thomas to retire. He’s been on the court for 27 years.

Didn’t that have to do with the fact that the Repugnants had control of the Senate when BO nominated Garland? So, in 2019/2020, Repugnants still control the Senate and should be a green light to move ahead with a nomination should the opportunity arise.

Yeah, and they used as their excuse the Biden rule that said the Senate should not consider a Supreme Court vacancy in an election year. Should RBG die or retire next year and the Senate move to fill the seat then they're going to pay a penalty for their hypocrisy. It could cost them in the election, that's all I'm saying.
