Dallas police officer who shot man in his own apartment indicted

(CNN)A police officer who claimed she killed a Dallas man in his own apartment in the mistaken belief that he was in her home has been indicted on a murder charge, according to a clerk with the Dallas County court.

The court records Friday showed both a manslaughter and murder charge entered in her file, but the clerk confirmed that the murder charge is the one prosecutors are moving forward on. The indictment of Amber Guyger comes more than two months after she was arrested in the shooting death of Botham Shem Jean at the Dallas apartment complex where both lived -- a killing that sparked days of protests. Guyger, who was arrested and fired from her job as a Dallas police officer after the September shooting, initially faced a charge of manslaughter. But Dallas County District Attorney Faith Johnson had said a grand jury could issue a stiffer charge.

don’t get me wrong, i think it is murder, but in the verbiage of legalese i just think it’ll be hard to get a conviction...

i think reckless homicide or depraved indifference to human life would be easier to convict on, then make sure she got the max term

I saw the photos that night. There was a bright red rug in front of the guy’s door. Now if I don’t have a bright red rug in front of my door and lo and behold I am standing on one, then how can I think I am at my own door???

According to the news, his door wasn’t latched, when she went to use her key it apparently went open, she entered a dark room and saw a large man coming toward her. She should have drawn weapon and demanded him to stop. Probably scared s—tless.
About the same time this happen there was a story on the news about two black dudes after having a dispute, agreed on phone to meet and fight. One took a kitchen knife with him and ultimately stabbed the one to death. Charge against killer? Manslaughter. We do have a two tier criminal justice depending on states’ interpretation of criminal offense.

Yep. Prosecutors have been known to over charge, failure to convict on first degree capital murder insulates from a manslaughter charge that would stick, thanks to double jeopardy.

That is what the witnesses say happened.

She was "banging on the door".

Don't know about you but when I lived alone I never knocked on my own door. There was a very bright red mat outside his door that was not outside hers and, while on the phone with 911 she had to step outside in order to give them the address. Not something you would have to do if you were in your apartment.

Add that in with the fact that she had complained about him prior and what you have is very nasty.

Yes, I would go for murder. Not murder in the first because I don't think she went up to shoot him. I think she went up there to try to intimidate him.

The only mistake was that she did not know who she was going to be confronting. Instead of a little old lady who played her church music too loud she met a very large black man. Instead of intimidating she was the one intimidated. Her training kicked in, when you are afraid, startled or annoyed, shoot.

So much for all the barracks lawyers who said she’d walk on the basis of “mistake in fact”. A fact has to be reasonable- what she did went well beyond the pale of reason.

You don’t kill someone by “accident” and walk away, cop or not.

No, blame the lame duck affirmitive action DAListening to the news conference this afternoon was sickening. Texas Rangers headed the investigation and recommended manslaughter charge. DA made it plain that they were going for the murder charge pure on racial reasons

Not quite. She went to the apartment and walked right in a supposedly automatic self locking door. . Not trying to justify her actions after she entered, but the entry itself appears to be a tragic mistake

If the witnesses are correct in what they say they heard I do not see how it could be anything but murder.

The Grio? what is that? The statement was from the families race hustler lawyer. The case was investigated by the Texas Rangers, I’ll place more trust in their integrity
