Judge Grants CNN’s Motion to Restore Jim Acosta’s White House Press Pass

WASHINGTON—A federal judge granted an emergency motion to restore the White House press credential of CNN correspondent Jim Acosta—a victory for the network in a closely watched press-freedom case.

The lawsuit could determine whether the government can ban individual reporters from public buildings.

District Judge Timothy Kelly, who was appointed to the bench by President Trump, granted CNN’s request for a restraining order temporarily restoring Mr. Acosta’s press access to the White House while the case proceeds.

Lawyers for Mr. Acosta, the network’s chief White House correspondent, argued that the unusual revocation of a reporter’s press pass by the White House last week necessitated emergency action.

The President isn’t required to call on Acosta, nor to have any press conferences at all.

If he choose to still have them, just sit the idiot in the back corner, issue him a dunce cap, and ignore him.

From what I understand from reading it, is that the judge had a problem with the WH just arbitrarily revoking credentials without any definition of what violations have occurred. The POTUS stating that he could, for any reason, take any reporters credential probably did not help. The rules of decorum that will follow will serve to define what is expected in order for the press corps to retain their privilege. At least this is how I see it.

Due process to what? Acosta and every other correspondent can have their privilege revoked at will by the Executive Branch. Also, he was not detained, arrested nor prosecuted; there is not a Constitutional right to any of this at all.

The Executive Branch has Constitutional rights (Enumerated in Article II Section 3) to ignore any and all reporters as well as having the right to dictate the decorum along with access to those who exercise a privilege the White House is providing.

Speak of the devil. The WH WILL be issuing rules for reporters. I guess it was never done before because it was believed that reporters would behave themselves.

Once again, unconstitutional micromanaging from black robed tyrants.

This will continue until patriots decide they’ve had enough tyranny.

Imagine, one federal judge ordering the Leader of the Free World, the Chief Executive, the Commander-in-Chief, who he must invite to the White House.

Imagine if Acosta acted this way IN THAT JUDGE’S OWN COURT ROOM, how long he would last!

Who is giving POTUS the names of potential judges to nominate? Never-Trumpers? They must be smirking their arses off, just like their comrade Acosta.

Read the White House Press release regarding the Judge’s ruling. Trump has already surrendered. Sucks, I thought he was going to surround the White House with the same Troops that will not stop a single Caravan illegal.

I think a bunch of people should just demand to apply for a press pass, and argue that they should get it on basis of being a journalist and having first Amendment rights.

The entire First Amendment is about how the government can’t just arrest you for what you wrote or said, so long as you weren’t violent and threatening in doing so, simply the fact that it implies the government being wrong or doesn’t agree with them is fine. BTW, did we ever bother pardoning the man who made the offensive Islam video on YouTube that got blamed for causing Benghazi?

Once again, due process was ruled to be in violation because the WH unilaterally revoked CNN's "asset" ie press pass.

What many people seem to be having a hard time understanding are that privileges, rights, ownership, etc can accrue through usage and (implied) acceptance of said claim(s). (The legal term is adverse possession.) In other words, a right becomes 'property' that can be transferred, sold, assigned, etc.

To summarize, it has *value*. Now, does anyone ever notice the long legal contract on the back of a parking or theater stub? What it specifically says is that the user only has a right to the specific conditions of usage ie performance/parking time, and that no other common law rights are created.

This ruling is in no way a victory for CNN; rather it's a major loss for the MSM. Because know Trump can revoke *everyone's* pass, establish a firm set of guidelines, rules and procedures governing codes of conduct, and then re-issue passes under those stipulated terms and conditions. Furthermore, there is nothing stopping Trump from setting up an application process where any citizen can petition for a pass.

If that comes to fruition, and if seating is limited to 50 people or so, guess what happens when there are 10,000 requests? Lottery time. CNN/Acosta totally and completely screwed a cozy insider game for everyone in the MSM. The 5A ruling is a disaster for them.
