The concept of first country of asylum (Trump is a Genius)

Introduction: International Standards

The concept of first country of asylum is defined in Article 26 of the APD:

A country can be considered to be a first country of asylum for a particular applicant for asylum if:

(a) s/he has been recognised in that country as a refugee and s/he can still avail him/herself of that protection; or

(b) s/he otherwise enjoys sufficient protection in that country, including benefiting from the principle of non-refoulement; provided that s/he will be re-admitted to that country. In applying the concept of first country of asylum to the particular circumstances of an applicant for asylum Member States may take into account Article 27 (1).

It should be noted that Member States are not required to apply the concept of first country of asylum, as Article 26 is a permissive provision.1

However, in accordance with the APD, those Member States which apply the concept are not required to examine whether an applicant qualifies as a refugee or for subsidiary protection status, where a country which not a Member State is considered as a first country of asylum for the applicant pursuant to Article 26.2

In other words, the Member State may consider such applications as inadmissible.

(hat tip seastay)

<><> PDJT, with cooperation from Mexico’s Nieto, has sprung a legal trap based on longstanding intl law.

<><> intl refugee law is the UN’s 1951 Refugee Convention, ratified by 145 UN member states including Mexico and US, administered by Geneva-based UNHCR.

<><> Article 27(1) established the concept of ‘country of first asylum’.

<><>It is the first country reached by a person seeking asylum status that meets two criteria: (a) that country has offered the person refugee status, and,
(b) that country also offers sufficient protection from the conditions causing the refugee to seek asylum.

<><> ergo, Mexico’s offer to provide caravan members with asylum, housing, schooling, and work means it IS the country of first asylum.

<><> also means automatic entitled to UN assistance from UNHCR (financial medical, tents or other housing, food-—none of which is directly on the US nickel).

<><> Refugees may also seek asylum in third countries, and the first country MAY allow this under Article 26(2)(a)
‘reassignment’ (especially if first country refugees prove burdensome), but ONLY IF the further move is safe from ‘refoulment’.

<><> ‘Refoulment’ is defined as a risk of a refugee being returned by third country to country of origin from which fled seeking asylum.

none of which involves the US nickel).

I hope Mexico soaks the UN but good.

And the second part is ...

Member States which apply the concept (ie, The US of A) are not required to examine whether an applicant qualifies as a refugee...

Since they were offered refugee status in Mexico, we don't even have to entertain a refugee claim

... "Denied ... NEXT "

And who funds the UN? The US, that is to say you do. Might as well just move a “family” into your attic, its cheaper in the long run.

The left only likes (loves) international laws when they agree with the laws. Just like US laws they don’t like, the left will be screaming that this is “racist or something”.

Trump will win legally and the people will continue winning bigly and that will just infuriate the left more. CNN & MSNBC will have 20 hours a day of “legal scholars” telling us why the law doesn’t mean what it says.

Great find. End asylum shopping now that treacherous Americans are coordinating with hostile foreign countries like Mexico to exploit our generous asylum policy simply because we are trying to stop the illegal alien invasions Mexico encourages.

Trump is a Genius------rolling out the concept of "first country of asylum"....

Even rocket scientists and brain surgeons can't match Trump's spatial intelligence.

Trump sees things from several angles, usually solving the problem before it even becomes visible.

Mexico, for all it’s faults, did us a big favor in extending asylum to the refugees. It makes it very difficult for the refugees to claim asylum status in the US when granted in Mexico.
