Asylum seekers sue Trump, claim border stance violates their Constitutional rights.

A dozen migrants traveling by foot from Honduras to the U.S. to seek asylum filed a class-action lawsuit Thursday against President Trump, the Department of Homeland Security and others, claiming a violation of their due process under the Fifth Amendment.

The Fifth Amendment states that, "no person… shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law."

A recent PBS report cited former Supreme Court Justice Antonin Scalia, who ruled in 1993 case that "it is well established that the Fifth Amendment entitles aliens to due process of law in a deportation proceeding."

They want to be treated with due process? Here is their due process under the law

Specifically U.S. Code § 1158 - Asylum :

(a) Authority to apply for asylum

(1) In general

Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.

(2) Exceptions

(A) Safe third country

Paragraph (1) shall not apply to an alien if the Attorney General determines that the alien may be removed, pursuant to a bilateral or multilateral agreement, to a country (other than the country of the alien’s nationality or, in the case of an alien having no nationality, the country of the alien’s last habitual residence) in which the alien’s life or freedom would not be threatened on account of race, religion, nationality, membership in a particular social group, or political opinion, and where the alien would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection, unless the Attorney General finds that it is in the public interest for the alien to receive asylum in the United States.

Now, since they were offered asylum in a safe 3rd country - Mexico and they turned it down, they are not eligible

We all knew this was inevitable as the socialist globalists will not let something like a thing called law stand in their way of destroying our national sovereignty to achieve their goals of bringing America to its knees. There will be other lawsuits filed to buttress this one, likely many more to flood the liberally judicially activist biased federal courts in hopes getting one of more to stick with a ruling they favor.

Right. Even the ACLU admits no foreigner has a Constitutional right to enter the United States. If the Govt want to not let you in, you can’t sue anyone to get in.

They (and their anti American lawyers) want to change our laws to accomodate their staying in the US ... free.. and taken care of. They wish!!!

Now, if it be any other political person... running for office or will be running for office... or already in office... they could get their wish. BUT President Trump is the person sitting in the oval office... he can’t be bought and he can’t be coerced!

Compassion and obeying our laws, sometimes clash... and that’s when common sense sets in. Without it, they’re a mass of confused flesh trying to outsmart the system.

They’re not even here, they sure aren’t citizens, and they claim to have “constitutional rights” under the Constitution of a foreign land??

Isn’t there an international treaty that says that a person fleeing any kind of danger must seek asylum in the first country that he she enters after leaving their dangerous country? If I’m correct on that (which I’d bet I am) then Guatemalans should be seeking asylum in Mexico rather than the US and Africans should be seeking asylum in Italy or Greece rather than Britain.
