Yes no doubt but given the quality of the recording we really don’t know what she was up to. The concern l have is a political one not a legal one. Conversations sliced and diced can be devastating from a PR standpoint. There is some danger here and Trump team dismisses it at their peril.
Maybe the acoustics are very different in the White House from our normal environment.
I heard the tape on TV. At first I didn’t realize what I was listening to because it was so clear. Almost as if it had been doctored and cleaned up from any background noises.
Several months ago I read about a program that could duplicate your speech after it “listened” to a few minutes of your voice. The program could then have “you” say anything.

I thought it was (is), lacking a warrant, seriously illegal to record anyone anywhere anytime without their knowledge and consent. One of our local bar owners became a convicted felon (and lost his business) because he wiretapped his wife.
