Official: Councilmen accused of child sex assault can't be forced from office

Kittanning Council does not have the authority to remove a councilman from office despite charges he engaged in sexual contact with a disabled 14-year-old, Council President Kim Chiesa said Friday.

On Thursday, Council Vice President David John Croyle, 60, was arrested and charged with felony counts of statutory sexual assault, involuntary deviate sexual intercourse, unlawful contact with a minor, aggravated indecent assault of a person with a mental disability, corruption of minors and related charges.

Croyle is the editor and publisher of the Kittanning Paper and senior pastor at the Family-Life Church on South Jefferson Street in Kittanning.

Also arrested and facing identical charges is Applewold Council President Mark Alan Feeney, 55, who also serves as chief of the East Franklin Township Fire Department and fire marshal for North Buffalo Township.

According to court documents, the victim told police he first met Feeney in 2016 at Riverfront Park in Kittanning through a mutual friend. The victim told police Feeney scolded him over his contact with their mutual friend, an unidentified adult, and told him not to have further contact with the man due to the victim’s relative age.

Despite this admonishment, according to court documents, Feeney later sent the victim a Facebook friend request and began to have sexually explicit conversations with him. The pair began to exchange nude photos sometime after that, police say in court documents.

Around Easter of 2016, police say, the victim met Feeney at his Ridge Road home in Applewold on three occasions for sexual encounters.

Police say Feeney referred to his home as “the Hangout.”

So this pedo creep is on a Borough Council, and apparently under PA law he can NOT be removed from office, despite being charged with a sex crime?

Even though the victim is a disabled 14-year old?

Another councilman from a nearby town has been charged as well. The guy from Kittanning is also THE PASTOR OF A CHURCH, and owns a newspaper and a radio station.

As George Carlin said, they're the people whose deepest, darkest secret prevents them from seeking higher office.

Oh, and our old friend Facebook plays a pivotal role in this story too.

Accusation/Charges do not imply guilt.

Once tried and found guilty THEN crucify him.

Don’t be a demoncrat and hang some one just because of the

serious nature of the charge.

This guy meets all the qualifications of a lib:

A pervert of the sickest order.

Owns a newspaper to spread propaganda.

Owns a radio stations to spread propaganda.

Is untouchable.

Since the incarcerated tend to cash-in child molesters, I’d say a couple weeks with the general population would be a good sentence, with a sign hanging around his neck: “I molest handicapped children”. And another sign on the bulletin board giving a reward.

Between this photo attached to the linked article and the fact that political party affiliation isn't stated I'm fairly confident he's a Democrat. Perversions aren't exclusive to either party but they do also tend to be more commonplace and tolerated on the "D" side of the scale.

Does anyone really want the standard for removal to be the mere accusation of wrong-doing, or instead, or being found guilty by a jury of your peers?

Very true! At the same time, they could have a recall election, or the council could simply shun him at the meetings until his trial is concluded.
But I do wonder at the wisdom of not having him “stand down” as a council member while the litigation is pending. Consider what would be done if the guy were a cop. Would he not be taken off duty?

A former mayor of a small town in NC was convicted and is in prison on similar charges, but the town still pays his pension and insurance. Town attorney says it has to do so, he earned them and can not be legally denied what he earned. I am still trying to understand insurance being paid, he has healthcare provided by the prison.
