Judge orders migrants returned to U.S. in midst of deportation flight

(Reuters) - A federal judge on Thursday ordered an immigrant mother and daughter brought back to the United States after learning during a court hearing that the government had put them on a deportation flight to El Salvador.

The pair were among 12 plaintiffs in a lawsuit brought by the American Civil Liberties Union (ACLU) challenging changes in asylum policies ordered by U.S. Attorney General Jeff Sessions.

Washington D.C. District Court Judge Emmet Sullivan was hearing a request to stay the plaintiffs’ deportations, when the ACLU learned that two of them were already on a flight to Central America, the civil rights group said.

Upon hearing the news, Sullivan ordered their flight returned and suggested that Sessions could be held in contempt of court, according to the ACLU.

An official from the Department of Homeland Security said in an emailed statement that the agency is “complying with the court’s order, and upon arrival in El Salvador, the plaintiffs did not disembark and are currently en route back to the United States.”

During the hearing, the judge ordered a temporary stay on deporting the nine women and three children who filed the lawsuit, according to a court filing.

The lawsuit was filed on Tuesday in the District of Columbia by the ACLU. It challenges a recent tightening on standards for seeking U.S. asylum, which makes it far more difficult for those fleeing domestic or gang violence to win the right to remain in the United States.

Trump opened this door when the judge in Hawaii said he couldn’t restrict immigration from7 muslim countries. He appealed instead of saying the judiciary has no standing on immigration and atonal security.

Now he has picked up the tar baby and has tar all toe him and is being blocked every other day in some manner.

Every time a judge’s order like this one is complied with, it enhances their power and further reduces the ability of the Executive Branch to run the government and defend the country.

Problem is, all these government agencies are still filled top to bottom with Obamunists who agree with these judges' rulings and will joyfully comply with them.

Yes. No doubt advised by the backstabbing rino squishes(See Sessions, et al) in his admin warning him to appeal rather than ignore.

I’m amazed at how myopic people are on ‘our’ side. Like the 8 years of the O’muslim regime never happened. Like we didn’t have marxists, maoists, and muslims in control of the executive branch for those 8 years. Like the whole of the fed gubbermint wasn’t irreparably corrupted...especially the courts.

When will our side EVER flip the finger to such orders. Obama did it constantly. The coup plotters in the CIA and FBI have done it constantly. Lois Lerner did it. Eric Holder did it.

I took a lot of guff for saying it but I said from the beginning that Trump should have told that Judge to pound sand and ignore him, tell him we will see you at the Supreme Court.

He has brought this upon himself for not doing exactly that. These Judges simply do not have the authority nor do they have the means to enforce their unlawful orders.

There is NO WAY Sessions could have been legally held in contempt of court.

You see, the court has rule (was it 6/3 or 7/2) that the executive branch has the power to enforce immigration laws and decided who shall and shall not entered - if arriving illegally.

There’s too much of this going on. Something stinks here. ANd folks might not like me saying this, but I’m starting to hold Trump responsible for not taking action against this.

Oh Congress? gave up on them long ago.

90% of the senior litigators in the DOJ are Democrats or RINOs who support massive immigration.

The only way Trump can find competent Conservative representation is to hire private litigators with his own money.

If it gets Sessions indicted and Trump can say obviously anyone under indictment can serve as AG so Trump has unarguable reason to fire him, then I will support the judge.
