In remarks unearthed from a 1998 symposium, Brett Kavanaugh took the ultimately banal position that the Constitution envisions Congress as the proper institution for investigating presidents, not independent counsels. CNN believes that while this is consistent with other public statements already known, it raises new questions about his confirmation.

So, Kavanaugh has been consistent regardless of which party controls the WH. Naturally, this is unacceptable.
Democrats are nothing more than a wind sock.
The HotAir article is well written and worth reading. Most of what passes for knowledge of independent vs. special counsels is complete and often deliberate confusion.
And by the way, one of the best ways to understand the connection between the separation of powers and individual freedom is to read Scalia’s dissent in the original independent counsel case.

Actually I have no objections to Special Counsel/Independent counsels, whatever, if everything about the reasons for appointing them are 100% open book to the public, in post election political situations.
Since Russia collusion is not a statutory crime, it could only be political disaster if proven, I am seriously perturbed by the secrecy of the whole process.
The media, and other leftists, is digging into the past looking for something they can get on Kavanaugh. If they don’t find anything, they will make it up.
democrap operatives use their job related access to private information to look into the records of Republicans. If they find something, they pass it along. None of them have ever been prosecuted for violating privacy and illegally accessing files. They will never be prosecuted.
There are a lot of dems at the DMV, in the tax office, in public records, in the court system. They willingly break the law and inspect confidential information.
