If you are concerned about government surveillance, you should be skeptical of Brett Kavanaugh

The Fourth Amendment broadly guarantees that Americans should be free from government intrusion in their homes and private lives and that infringements on these rights must come with the justification of a warrant or probable cause. These guarantees and protections form the basis of property protections and a right to privacy both of which are fundamental to individual liberty.

In 2015, Kavanaugh went out of his way to minimize these protections. During his tenure on the U.S. Court of Appeals for the D.C. Circuit, he issued a separate concurrence in the denial of a rehearing en banc in Klayman v. Obama. That case dealt with the constitutionality of the National Security Agency’s collection of telephone metadata of all Americans. In telecommunications, metadata is the information on the length and time of calls and their origins and destinations which includes a sweeping amount of data and can offer broad details of the private lives of Americans. In his statement, Kavanaugh sided with the government writing, “In my view, the government’s metadata collection program is entirely consistent with the Fourth Amendment.”

I guess this nomination makes political sense, but I just don’t like the guy. He is a moderate and he is going to disappoint.

I support Kavanaugh as well. Pres Trump has followed Ronald Reagan’s advice of choosing the conservative nominee that has the best chance of being approved for whatever position. He also has a solid reason for making the choice of a particular candidate. I trust that Pres Trump has, as usual, has chosen wisely.

You would think people who have lots of weapons might also understand at least the most basic bit of information security, i.e. don’t tell potential attackers what your defenses are.

Why would a government that gains from snooping on us want to resolve that problem? They don’t consider it a problem. Same goes for Google, Facebook and that lot.

True, but the same, with respect to most of those in charge of the government, can be said for Globalism, Free-Trade, and Tariffs.

They did not want to deal with those issues as well, but our President forced them to.

Exactly. There’s only one person that needs to know what you have. You. If you have a spouse, she should be capable too just in case you’re not home at some point. She should understand the need for secrecy before anything else.

If the controls are properly followed, this is not too bad. The problem is, we already know the FBI issues subpoenas with false data to access this, and then dig deeper.

Read his opinion. What he actually says is that the Supreme Court has spoken on this issue and so the court of appeals is bound to follow.

It's how rule of law works.

Lets be clear, this isnt published data.. this is your texts to your nearest and dearest. Without a warrant. If you dont have a warrant its unxonstitutional to access your personal devices.
He picked a moderate in the same way he welcomed Syrian rapefugees. Fear.

Well said. So, yes, I have concerns about Kavanaugh's role in Klayman v Obama. On the other hand, what SCOTUS current justices and other potential nominees would have defended the 4th Amendment against the deep state?

I agree, but tens and perhaps hundreds of millions of us don’t.

Some folks didn’t grow up on a farm and learn about guns early in life. They’re actually afraid of them.

I believe it’s a man’s responsibility to be able to protect the home from intrusion or attack so his spouse and family are safe.

In an uncivil world, guns are what guarantee a civilized society.

You may not prevail, but those who screw with you unprovoked or unreasonably, stand to pay a heavy price.
