PHOENIX (AP) The U.S. Justice Department says an appeals court overstepped its bounds when it ordered the appointment of a special prosecutor to pursue an appeal involving a pardon of retired Arizona Sheriff Joe Arpaio.
The appointment was previously ordered by a three-judge panel of the 9th Circuit Court of Appeals.{snip}
The Justice Department said in its appellate brief that the government does not abdicate the prosecutorial function when it agrees with a defendant on a legal question.
Arpaios attorneys argued that appointing a special prosecutor raises serious questions about whether the court is actively participating in the prosecution...."

It’s time for Americans to start “protesting” in the streets to demand that the 9th Circus Court be abolished.
Actually a good chance for the Supreme Court to stay that a pardon is ABSOLUTE and that no government entity, such as a rouge DA in New York City, can then file charges against someone who has been pardoned.
Would be fun to see that BACKFIRE in their faces.

Actually, a presidential pardon only covers federal crimes, so a local prosecutor can bring charges for state crimes.
We’re overdue on the SC ruling that this sort of thing violates the Double Jeopardy clause.
Ping to 9th Circus trying to screw Sheriff Joe one more time!
DOJ refused to litigate to support the 9th Circus ruling that Arpaio’s conviction should still stay on the books even though he was pardoned by Trump, so the 9th Circus appointed a Special Prosecutor to do the dirty deed!
Now DOJ has to litigate to try to prevent this.
The Supreme Court of the United States is the supreme court in the land, of all courts, every one of them.
The 9th will be struck down again by SCOTUS ruling they have violated basic principles of double jeopardy.

Only congress can disband the court.
He can change it or leave it as it is.
However, if he leaves it as it is it needs to be properly named.
I vote for the “Illegal Aliens and Criminals Appeals Court.”
Then Trump can appoint other not insane judges to the new Ninth Circuit Court.
It would probably be more effective the old fashioned way - thousands and thousands of mailbags delivering hundreds of thousands of letters to our congresscritters, with one sentence - dissolve the 9th.
