Man accused of stabbing pregnant girlfriend, killing unborn baby

A Bronx man who suspected his pregnant fiancee of cheating on him repeatedly stabbed her, killing her unborn child — then fled with her cell phone so she couldn’t call for help, cops and sources said Tuesday.

Oscar Alvarez snapped during an argument with Army vet bride-to-be Liv Abreu at their apartment on Walton Avenue near East 165th Street around midnight, grabbing a knife and plunging it into her six times, cops said.

As the 26-weeks-pregnant Abreu lay bleeding in the fourth-floor apartment, Alvarez then spent about an hour cleaning himself up before running off with her cell phone and car keys, the critically wounded woman told detectives from her hospital bed, according to sources.

Her unborn child — whom she hinted on social media was a girl — could not be saved.

Alvarez was charged with murder, assault, and criminal possession of a weapon.

Now, this raises a question. He was charged with murder. His fiancee, whom he stabbed, is injured but alive. Whom did he murder? What person did he murder?

And why is killing that person in different circumstances considered OK?

New York is not among them.

That touched on a Federal law against killing the unborn (I believe during the commission of a crime).

This law condemns any killing of a human at any stage of their life, even prior to birth.

38 States have their own such laws.

I posted a source naming them just after your post.

So why is it OK for a so-called “doctor” to do it and collect a fee?

Either it’s a person or it’s not a person.

If it’s a person, as the Unborn Victims of Violence Act would say it is, then it’s protected by the Fifth and Fourteenth Amendments.

Do you see my point?

He can plea to performing abortions without being licensed. Probably a misdemeanor. He will get off this then with timed served /s if that it needed. This should be a death sentence for the perp. I have some bullets I’ll loan the executioner.

Certainly I see your point. The only distinction as I understand it is the inclusion of a requirement that it take place during the commission of a crime.

To you and I, abortion should be a crime, but that’s not what they were seeking as a contributing factor in the Federal Unborn Victims of Violence Act.

At least 38 states have protected the unborn, with similar laws, but again I think they require it be during the commission of a crime. They aren’t going to consider an abortion the commission of a crime.

#2: A woman who kills a baby between conception and birth is a murderer and should be treated as such.

Unfortunately, despite recognizing the truth of #1, millions of people deny the truth of #2.

The important thing to me is to get the number of abortions as close to zero as possible. Anything that focuses on the life of the innocent child is the way to go > IMO.

Why do I say this?

The approval of abortion has gone down. People do not see it as a good thing to do, killing these unborn kids. Even young adults have come around to see abortion as something undesirable. Are they where we are on it yet? No, but polls do show it is moving in our direction.

It’s my take that the more we focus on the unborn child’s innocence and their protection, the better off we’ll be.

If we focus on very stern punishment for women, it’s going to send warning bells to young women and we’ll set ourselves back a decade or more.

As it is, there are fewer and fewer abortions taking place. While it’s not the total solution, it’s certainly better than it was.

I think we should play up the goal as adults, to seek ways to reduce the numbers of abortion as much as possible by choice. This is something people on both sides can agree with as a goal.

Maybe some folks will come up with some creative ideas to advance toward that goal, even on the Left. It beats going head to head on it, creating a fear the Left can exploit, and hurt out chances to get a guy like Trump elected again.

I don’t think this will end overnight.

Defunding Planned Parenthood should be a number one goal right now. It would impact abortion numbers rather significantly > IMO.

If I'm his lawyer, I use Roe v. Wade as a defense. If it's not a human being, as Roe establishes, then you cannot murder it.

OTOH, if Roe is wrong (as we all believe), then the unbron is entitled to both Fifth Amendment protection ("nor be deprived of life, liberty, or property without due process of law") and Fourteenth Amendment protection ("the equal protection of the laws".)

I'd love to see a lawyer try using Roe as a defense in a case like this. it would make a great test case.
