Judge rules Trump can't block users on Twitter

A federal district court judge on Wednesday ruled that President Trump can't block people from viewing his Twitter feed over their political views.

Judge Naomi Reice Buchwald, of the U.S. District Court for the Southern District of New York, said President Trump’s Twitter account is a public forum and blocking people who reply to his tweets with differing opinions constitutes viewpoint discrimination, which violates the First Amendment.

The court’s ruling is a major win for the Knight Foundation, which brought the lawsuit on behalf of seven people who were blocked from the @realDonaldTrump account because of opinions they expressed in reply tweets.

How does “viewpoint discrimination” on his own private twitter account violate the first amendment?

And this judge has the power to order the President to do anything—how?

First Amendment, free speech. Fourteenth Amendment, equal protection. realDonaldTrump can’t be singled out for special mistreatment.

You have the right to free speech, that is true Mr Kangaroo Court Judge

However, you do not have the right to be heard. If President Trump does not want certain people on his Twitter feed, he has the right, under our constitution to block them if the technology exist, and it does.

Just because a group of protesters show up outside my house, does not mean I am required to listen to them. I can blast my stereo and drown them out. I can even take my stereo outside and point the speakers at them and blast back whatever I want.

1st Amendment works both ways Mr. Kangaroo Court Judge. Don’t you have some speeding ticket cases to preside over in the next hour?

Perhaps Twitter should be forced to remove their BLOCK feature.

All they have to do, I believe, is log out and they can view everything President Trump posts.

Moteover I think there is a stronger case that twitter in genral is more of public square or youtube in genral is more of a public square or facebook or reddit etc. And that somebodys twitter feed or youtube channel or facebook page or subreddit etc is a tent in the public square that can form its own rules of discussion and etiquette. Those that dont like it may set up their own tent with their own rules. The Left seeks to tear down out tents because they are not able to win the debate.

The key is her ruling that:

President Trump’s Twitter account is a public forum

So she is narrowing it to say that his account is a public forum, not all twitter accounts. Not sure how she makes that leap though. However, anytime a Democrat President sends a tweet I guess we are free to lambaste him/her at will. Perhaps it even extends to all politicians.

The ruling should open a can of worms for every social media platform.

I don’t know how they can do that. He has two Twitter accounts. One is POTUS and that’s the official account as Potus. The @realdonaldtrump is his personal account. I can block trolls from mine so he shouldn’t be treated differently than anybody else is. The people complaining about being blocked were vile vulgar Dems that were practically shutting down his Twitter feed. I don’t even read the replies to his tweets now because that’s all it is.

I expect Barnes Law is already working this decision into their case against Twitter.

Current Case:
Charles Johnson vs. Twitter, Inc.
CHARLES C. JOHNSON’S LAWSUIT FILED AGAINST TWITTER ON JANUARY 8, 2018. THE BIG QUESTION IS WHAT HAPPENS TO FREE SPEECH IN THE PUBLIC SQUARE WHEN IT’S OWNED BY A PRIVATE MONOPOLY.

So, if I’m not mistaken, the judge’s ruling means Twitter and Facebook are common carriers subject to regulation by the government.

I said same on Twitter.

Judges getting involved in tech rulings had better show they understand the tech before issuing Anthony Kennedy-style BS.
