Judge rejects Manafort attempt to dismiss criminal case

Federal Judge Amy Berman Jackson on Tuesday rejected former Trump campaign chairman Paul Manafort's attempt to invalidate the criminal case against him in Washington.

Manafort had claimed special counsel Robert Mueller's appointment order was too broad, and thus his investigation had overstepped its legal authority.

But Berman Jackson concluded for several reasons that Mueller's investigation and prosecution of Manafort is legal -- and that the special counsel still can maintain some independence while working within the Department of Justice.

Manafort has pleaded not guilty to charges related to his lobbying work for Ukrainian politicians dating back to a decade ago.

Actually this judge has ruled against Obama as well. I don’t think you have to automatically assign to a federal judge a prejudice based on the president who appointed him or her.

Judge Ellis is the good guy. The judge in this article is judge Berman-Jackson. Their courts are in completely different jurisdictions. We will hear from Judge Ellis later this week, and it should be very interesting indeed.

You still have discovery, cross exam and appeal. Lots of billable hours ahead. Meanwhile judge Ellis looks to be unfriendly to Mueller in the other part of this.

“Judge Jackson seems pretty swampy, but could potentially be impartial, she has a varied history, but the fact that her son was on Jeopardy caught my attention too.
In one of his early “Jeopardy” appearances, Matt Jackson made a passing reference to his mom, explaining to host Alex Trebek that his knowledge about a wide variety of subjects came from his eclectic upbringing.
“My mother is white, liberal and Jewish, and my dad is black, Christian and conservative,” he told the host, who seemed a bit surprised.”

Evidently the tax charges have to be filed in the jurisdiction where the defendant lives. In Manafort's case that is Virginia.

The judge would probably rule that unless the President and the Senate object under those Contitutional circumstances to Mueller as acting as an official US attorney, she might rule that there has been tacit agreement by all parties concerned that he continue to so act!

Should an objection be raised by either the Senate or the President to Mueller acting as defacto US attorney with broad powers, then it becomes a different ball game!
