Michael Cohen to plead the Fifth in Stormy Daniels defamation suit

Michael Cohen, President Donald Trump's personal lawyer, will invoke his Fifth Amendment rights against self-incrimination in a California defamation suit by Stormy Daniels, according to a court filing late Wednesday. In the filing, Cohen said he's pleading the Fifth due to the ongoing criminal investigation against him by federal authorities.

Does not sound like he is about to fold to me. He would be dumb to cooperate with the fbi given what they have, and are, doing. The fbi is a criminal enterprise.

Nothing wrong with that. He's not going to get tricked into telling a lie or participate in their game playing.

What will happen is we will know where the prosecution is coming from.

P.S. Stormy's attorney cancelled an interview with Fox. He said Fox cancelled him...but Fox said...BS.

She’s the one who broke the settlement she signed to stay silent. She took the money, and then decided she wasn’t happy with the settlement. There’s no way he should testify in her suit.

It worked splendidly for Lois Lerner. She pled the Fifth, and retired to a cushy retirement. That should have set a precedent for all federal cases. Don’t tell the bastards anything so they can’t set a perjury trap for you.

The defamation case is a civil case. Can he exercise his Fifth Amendment right in such a case since it is not the State that is pursuing the case? It at least will severely limit his defense.

It's the only smart thing to do when you're under criminal investigation. The problem is that it may sink him in the libel case, because taking the 5th can be used against you in a civil case (but not in a criminal case).

Remember when Alberto Gonzales fired eight U.S. Attorneys and the Democrats in Congress wanted to investigate the reasons?

There was a young woman lawyer in the AG’s office. The Democrats subpoenaed her to testify. Even though she did nothing wrong, she asserted her 5th Amendment right against Self-incrimination.

Why did she do that if she didn’t do anything wrong? Easy answer; she didn’t have to hire an attorney to represent herself and there was no way a prosecutor could twist her words if she didn’t say anything.

The prosecutor kind of did Cohen a favor when he raided his office. He basically gave him the legal cover to plead the Fifth Amendment for the rest of his life. LOL.

Agreed. Talking with the FBI in this day n age is likely to result in an indictment of some sort...even if innocent.
