Court orders full restoration of DACA program

A federal judge in New York ruled Tuesday that the government must fully restart the Obama-era DACA deportation amnesty and accept brand new applicants as well as renewals, throwing a potential wrench in the ongoing debate over the fate of “Dreamers” on Capitol Hill.

Judge Nicholas G. Garaufis said the administration does have the power to revoke DACA, but it must give a sound reason for doing so — and the Homeland Security Department’s September 2017 rationale fell far short of what is required in that regard.

He becomes the second judge to rule President Trump’s aides bungled the phaseout — but his decision is the most wide-ranging, ordering the government to not only allow those already in the program to renew their applications but also ordering the government to accept new applications.

I understand SCOTUS will hear this on an emergency basis in March. (The overturning of the original illegal EO).

The Federal Judiciary has usurped and thereby voided all its authority. Just ignore anything that comes out of Federal District Court as it relates to separation of powers.

This idiot judge legislates from the bench again.

Social Engineering and Social Justice are the same...America is weaker because of both. This is supposed (?) to take your mind off the scandals like Hillary paying for the "dossier" etc. Had this been a democrat, the judge would have said nothing.

Congress makes law-NOT the President. Yes, a Pres can make an interim decision if in war/emergency, but; Congress must back it up to be LAW.

Trump should be in contempt and carry on with the correct plans. Unless someone changed the daffynition of “deferred” recently. Besides which, what’s enforceable to an illegal executive order anyway?

If revoking an executive order (or executive action) requires a strong rationale, you would think an even stronger rationale would have been necessary for creating DACA in the first place. Obama gave absolutely no such rationale - he presented no facts as to why DACA recipients are so indispensable to America that they require special protection from deportation, other than some typical liberal touchy-feely rhetoric about "social justice".
