My guns or my ganja? Firearm-owning pot fans face a choice

The federal government says grass and guns don’t mix, and that is putting gun owners who use marijuana — and the strongly pro-gun-rights administration of President Donald Trump — in a potentially uncomfortable position.

As gun-loving Pennsylvania becomes the latest state to operate a medical marijuana program, with the first dispensary on track to begin sales next month, authorities are warning patients that federal law bars marijuana users from having guns or ammunition.

“They’re going to have to make a choice,” said John T. Adams, president of the Pennsylvania District Attorneys Association. “They can have their guns or their marijuana, but not both.”

That’s the official line, but the reality of how the policy might be enforced in Pennsylvania and other states is a little muddier. That includes the question of whether people who already own guns might have to surrender them, instead of just being prohibited from making new purchases.

If they come for it, give back the ammo one bullet at a time.

No credit or debit cards processing at pot shops — no bank support.

Norton v. Shelby County, 118 U.S. 425 (1886)

While acts of a de facto incumbent of an office lawfully created by law and existing are often held to be binding from reasons of public policy, the acts of a person assuming to fill and perform the duties of an office which does not exist de jure can have no validity whatever in law.

An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is in legal contemplation as inoperative as though it had never been passed.

The states will push marijuana as a way to confiscate guns.

Sure, but don’t you see? Sessions may have to jail 100,000 native pot smokers and take away their guns, but by doing that he is also going to keep 122 illegal aliens from getting DACA, so it’s all worth it!

In Colorado you won’t pass the background check to buy a gun if you have a medical marijuana card.

But since recreational pot became legal 6 years ago, the only people who need med cards are household growers. Some commercial growers have cards, but those cards are in the names of people the growers are supplying, so the grower is not affected.

Interesting, that THIS is the law that they have chosen to enforce.
WHY AREN’T HILLARY CLINTON AND HUMA IN JAIL???
WHY AREN’T LORETTA LYNCH AND LOIS LERNER IN JAIL???

Because these are little nobodies who are likely to be stoned, not an actual threat to their life like a real Clinton Investigation.

One guy I talked to who grows in his house had his wife get a med card so he could grow and still buy guns.

Since we’re talking a Constitutional right a much higher test will be used, strict scrutiny.

Really? Then how are states with restrictive gun laws getting away with their unconstitutional infringements?

In my limited experience, guns don’t mix well with either pot or alcohol. But there is a difference. When handling a gun, pot smokers are likely to hurt themselves. Alcohol users are likely to hurt their family or best friend.
