My guns or my ganja? Firearm-owning pot fans face a choice

The federal government says grass and guns don’t mix, and that is putting gun owners who use marijuana — and the strongly pro-gun-rights administration of President Donald Trump — in a potentially uncomfortable position.

As gun-loving Pennsylvania becomes the latest state to operate a medical marijuana program, with the first dispensary on track to begin sales next month, authorities are warning patients that federal law bars marijuana users from having guns or ammunition.

“They’re going to have to make a choice,” said John T. Adams, president of the Pennsylvania District Attorneys Association. “They can have their guns or their marijuana, but not both.”

That’s the official line, but the reality of how the policy might be enforced in Pennsylvania and other states is a little muddier. That includes the question of whether people who already own guns might have to surrender them, instead of just being prohibited from making new purchases.

Many shootings are alcohol-fueled. Though I don’t use pot myself, persecuting pot smokers over their firearms is arbitrary and capricious and won’t stand after even a `rational relationship’ judicial scrutiny.
Since we’re talking a Constitutional right a much higher test will be used, strict scrutiny.

This man is not smart enough to own guns and smoke pot too.

He goes public in the paper with his real name and occupation, AND he registered to purchase possess that which is readily available everywhere with very, very little risk.

But the choice is not necessarily guns OR ganja. They could choose to be free men and do as they please.

It’s already illegal under 18 U.S.C. § 922(g)(3). It’s not a new law, just one that isn’t enforced all that much. Of course with Sessions at the helm, federal prisons may be getting filled up with recreational marijuana users who also happen to own firearms now. The GCA of 1968 should be repealed in its entirety, IMO.

I really worry about this....you know, after the boating accident.
I have a dope card.
I have it because I grow dope for two of my neighbors who have been fighting cancer, I have an ‘underused’ greenhouse.
In California I need to have the card to grow it legally, even if I do not use it.
That changed January 1st but I do wonder what ‘lists’ I may be on.

Ya, let’s start creating classes of people that are exempt from the Bill of Rights.

Sadly they already have — They put it under the guise of felony convictions these two pages enumerate a truly horrendous list* of rights a convicted felon loses… despite the longstanding thought in jurisprudence (and, indeed, philosophy) that completing the sentence of a crime balances the books and therefore restores all rights to the convicted.

To do otherwise creates a class of people for whom Rights aren't Rights, but instead may be treated as privileges/licenses [and thus outright denied] by the government. This sort of situation is incredibly dangerous to Liberty, as it can be very easy to expand these groups by making it easy to become a felon — for example, consider how easy it would be to swell the ranks of felons by bringing back ObamaCare's individual mandate with non-payment as a felony. Further, imagine how many people would sign a confession/plea-deal right off the bat rather than be harassed by the IRS. And BAM!, now you have thousands and thousands of self-confessed felons.

* The list:

  1. Firearms.
  2. Voting Rights and Jury Service.
  3. Disbarment and Doing Business with the Government.
  4. Armed Forces.
  5. Flying.
  6. Private Radio Licenses.
  7. Other Federal Licenses.
  8. Holding Federal Offices.
  9. Federal Employment.
  10. State Licenses and Occupational Restrictions.
  11. Federal Benefits.
  12. Travel Restrictions.
  13. Employment in certain fields
  14. Public social benefits and housing
  15. Parental benefits
